    You are unable to take any further action online on this claim.

    The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

    (This is the latest update, they have disputed and the next stage is thatit will go to my local court house: Kingston Upon Thames)

    45 days is working days mon-fri.

  • i entered into a contract with them last month. after reading all this im scared. lol:rotfl: erm i ha dto email them two days ago about the dodgy quality of goods sent.

    found it through quidco, but upon receiving the phone the box it came in looked as though it had been tampered with as in a bit squashed. Within the package, i found strands of hair. i contacted them and they gave me this reason:

    "You are obviously concerned that you have received a used phone. Without
    even having to research this I can guarantee that the unit would not be
    used, as if you read our terms and conditions of return, you will note that
    we do not accept used units back (unless faulty, in which case they go back
    to the suppliers). We do inspect many of our phones
    and they are mailed to you, which may explain the hair and condition of the
    box. Whilst most are received in excellent condition, the odd unit can come
    to a customer with a slightly damaged box."

    (they replied swiftly to the complaint i made especially threatening trading standards and threatening contractual breach of consumer rights (thank God for me studying law)

    I dont know if i should chase this up or even get other people involved. ive had quiet a few phones in the last couple of years and have never received them with damaged boxes. although i've only ever received one phone via the internet before from the carphone warehouse which was in good condition. any advice? feel free to pm me also. Thanx.

    Also. i cant remember the exact date my contract started, but plan to send the bills by recorded delivery. im on a 12 month contract. and set a rough reminder in my phone for 6 months time to remind me, but seems im in for a hell of a ride with them. can anyone offer advice as to when i should be sending back statements and which one.

    states :

    "N.B. For clarification the 6th month’s invoice is classed as the first invoice issued after you have had the phone for a period of 180 days from the date of connection (inclusive). The invoices for month’s 9, 12, 15 and 18 are therefore those you receive 3, 6, 9 & 12 months subsequently."

    So every one will find the tool here very useful (easier than using a calendar)! :

    It lets you add 180 onto the date the contract started - if you do add 180 here i think it is not inclusive to to be exact just add 179 days...

    Actually that web page is useful for any cashbacks, just seems some companies like to wriggle out of giving it - now i know why they can offer better deals than some of the more reliable companies - being slow and having many hoops to jump through gives them more profit to offer better deals to lure the unaware in...

    Can you do any thing more than just go through the small claims court - what about fax my MP ? Anyone got contactd etails for the local trading standards so you can get them to send a letter which would be cheaper than a small claim, potentially ? Their local trading standards will know them well and will have probably got template letters for them now...

    Hello,

    My saga with Phone2udirect has started today. Here are my details, and this is their response.

    12 month contract (with full cashback) connection on 31/07/06

    180 days from 31/07/06 = 27/01/07

    I receive my bills on the 6th of each month, so my first bill after 180 days of connection = 06/02/07

    Sent my bill dated 06/02/07, original purchase invoice, and all details as specified in T&Cs. This was all sent on 14/02/07 by Special Delivery. It was received by Phones2Udirect on 15/02/07.

    Today (24/03/07) have received following letter from them:

    I am writing in response to your claim received 15/02/07. Unfortunately we will be unable to process your claim for cashback for the following reason: (1) You failed to claim your first cashback instalment. This was due after 180 days from the date of connection. As per the terms and conditions all other claims are reliant on the previous claim being successful. Due to the above issues, we are now regrettably unable to process any further claims on this account......and so it continues

    So, I'm in bewilderment as this was my first claim (at 6 months)......

    Can anyone shed any light on this other than Phones2udirect being difficult?

    Most frustrating is that I cannot do anything about it till Monday - that's if they answer the phones!?

    Any help greatly appreciated.

  • just send them a letter saying this is the 1st cashback claim & they leave you no alternative but to issue a small claims court action as they are quite clearly in breach of contract.

    Thanks for your support. I've just sent a complaint to Ofcom (just to get it off my chest!). I will send a letter disputing their decision (by recorded mail) and will give them 10 working days to respond before I go to small claims.

    Does this sound the right course of action - is 10 days ok, or should I give them longer/shorter?

    I cannot believe they are trying to get away with this. They are complete scoundrels!!!!!!

    10 Days sounds about right,they will try anything in the book now to get out of paying money,its happening more and more but the more people like you who take the right course of action the better.
