    which is not very convincing but we will see as i have sent another reminder as it is almost two months now and they have not sent any cheque.

    Also would like somebody with a better knowledge to tell me that based on my above facts which will be my 9th bill is it 2nd April as based on their working first bill after 180 days was 2nd Jan 2007.I fear there may be another catch here....any help will be appreciated....reagrds and goodluck to everybody with their claims

    further update on my case.....Date 31/03/2007

    After writing them a letter on the 19th of march giving them all the facts and 1st warning to pay my cash back.I am in recipt of a cheque for £119.96 (first payment) which i fail to understand how they have worked out. As my contract was £30.00 for 12 months and the way i understand it should come to £180.00. Am i missing something ? any comment will be appreciated..goodluck to all

    It varies - if they can't come up with a reason to reject your claim (as was the case with me) then they just won't reply at all - they just bury their corporate heads in the sand and hope you'll give up.

    For what it's worth, I recently sent them a "Letter Before Action" giving them 7 working days to cough before I took legal action - still received no response so duly put the legal boot in in the allotted day. Had the desired effect - they sent me a grovelly letter for the full cashback, and included the £30 court fee (as they should, of course - but I've read here of cases where they haven't).

    All seems quite bizarre to me - having jumped through all their hoops, used recorded delivery throughout, sent umpteen reminders, and finally an official LBA by rec del too - they still waited for the legal action, which cost them more money! I assume there must be a fair number of punters who just don't bother taking it the final inch, to make it worthwhile P2Udirect taking the risk of ignoring them!

    For anyone who's happy they've got a valid claim, then I would unhesitatingly reccommend http://www.moneyclaim.gov.uk - it's really dead easy to use... and very effective! :beer:
  • yes you should claim it all. if they wont pay the 1st they wont pay the rest.
    I disagree - if the 2nd and 3rd cashbacks aren't yet due, then you can't demand them and they'll be able to legitimately defend your application. Just sue now for the first payment, and assuming you get that they'll have no cause to be able to reject your 2nd and 3rd payments in the future... if they do, just sue them again! It's very easy via moneyclaim.gov.uk, especially if you've done it once before... and besides, I imagine if you've successfully claimed from them in court once, then they are hardly likely to let you do it again!

    They are correct:
    £30 x 12 = £360 total cost over 12 months
    £360 / 3 = £120 in three equal installments

    They paid me every time last year - but did drag their feet - so don't give up hope!

    Well you could have knocked me down with a feather - my final cashback arrived today - only 119.88 rather than 120 so I don't know if they have unilaterally decided it was 12 months at 1p/month? Claim was submitted by garenteed next day by 1pm in December. Followed up with email about a month ago and message on anserphone on admin number about 2 weeks later both threatening legal action.

    DO despite getting back all my cashback I won't be using them again - hopefully pbd and tmo won't be such a struggle...why don't I have any confidence that they will be any better?

    Don't forget to cancel the contract.
    Your actual monthly cost has been £29.99 - so they keep it simple whole pounds until this last payment when you get 12p less. :cool:

    This is an interesting point for me. I have an 18 month contract with Phones2UDirect with full cashback.
    When I took the contract out it stated that I must send my claims within 14 days of the invoice date and that they will process the claim within 28 working days. I have always sent everything recorded delivery, on time and according to the contract.

    For the first 6 month claim I chased them by email and phone and then after 10 weeks I served them with a 14 day notice to pay and then they paid up by return.

    I then sent my 9 month claim in, and despite chasing them by email and phone they still didn't pay, so with my 12 month claim which I sent on Wednesday (28th March) I sent a 14 day notice for them to pay both my 9 month and 12 month cashback, or otherwise I would file in the small claims court for the remainder of the 18 month contract which '3' have confirmed they will hold me to.

    This morning I received just my 9 month cashback. Clearly they got my letter, but rather cynically only paid one of the cashback payments I requested. So I'm now deciding whether to continue to make a small claim. I think that as they have failed to honour their side of the contract, namely to pay within 28 days, and as they only pay when served with a notice, I'd be in quite a good position to win in a small claims court. If I don't persue the action then I fully expect that I'm going to have to endure chasing them for the remainder of the contract. Does anyone else have a view on what I should do now?

    Seems like there is an opportunity here for a website that scores mobile cashbacks based on reliability or other criteria, that would be very useful as soem of these can be good value if they work, but an awful lot of hassle if they dont.

    I also wonder if we can write to the networks whose phones they sell with details of what they are doing and how it is tarnishing peoples experience and ask them to stop dealing with Phones2UDirect ?
