  • 2nd cashback received today & to be fair it was on time. when i claimed it i quoted the date i should receive it by according to their T&Cs or i would issue a small claims. with 1 gentle reminder in the week that the date was approaching.
  • After sending Phones2UDirect a letter before action (on 27/03/07) I have not heard anything from them and their 10 working days is well and truly up!

    I have just spoken to my local Trading Standards, and they have been in touch with Kent TS. Apparently, Phones2UDirect are VERY well known to them! Surprise surprise!

    Anyway, I am now in the process of filing a county court claim against them (the website is really slow though, so might take a while!). I am going for the full 12 months cashback since they have stated in their letter than my 9 and 12 month claims will not be accepted. TS advised to do this, as the judge can always rule to just pay the 6 month cashback, and then give me the chance to apply for the 9 and 12 month cashback.

    I will keep you posted on progress.

    Right, so my claim has now been sent.

    One worry though - it only gave me 1080 characters to explain the situation (which I found very limiting). When (if at all) do they want all my paperwork and evidence etc? It seems quite weak without it all.

  • I've just issued a small claim against these th!eving t'nucs, it never ceases to amaze me just how companies like this are allowed to carry on trading.
    I had similar problems with the notorious E7even, it just goes to show/remind you that governments are about protecting business more than the individual...

  • Update. This morning (Thursday 19th April), I received a cheque for £140.00 and letter from Phones2UDirect. They didn't say they were wrong, but just said thank you for your claim, here is your 1st cashback instalment.

    I am now seething as I started my county court claim on 12/04/07 (the date I promised to file it!), and have subsequently paid my court fees.

    The letter and cheque sent by Phones2UDirect (and received 19/04/07) were both dated 11/04/07. I even kept the envelope, but it does not show any date.

    Anyway, I've notified the court that a cheque has been received, and I've been advised to cash it. I am worried that it will bounce since they might have cancelled it since receiving my county court claim. If it does, I will be left with even more money to pay out. I am also worried that they backdated their cheque and letter. I have got no proof it was received this morning as it was only sent by 2nd class with no postmark. They might just quibble that it was sent on 11/04/07 and its Royal Mail fault.

    Now what!!!!? The courts have told me they will let the claim run its course and see what response they get from Phones2UDirect, since I should be entitled to a full payment of my costs. However, I get the feeling this wont be that simple and they will fight.

    I got my final cashback from them today. It was several months late...but better late than never. I sent them a letter by Recorded Delivery and threatened legal action....I gave them 14 days to pay up, and they paid up within a week. If anyone wants a template I will be happy to supply it. Thanks
