    The network said that they would send an envolope to return the phone in but they haven't yet. It's still sitting under the coffee table.

    P2UD direct told me that it was only my emails that had got lost and that they hadn't had any other complaints. Is it me or are these guys really slimey? I live nearby so I may call round to see what their operation looks like.
  • Right, here's the thing! I too sent in the wrong invoice to P2UD, a month early, and I too got a letter that arrived, purely by chance I'm sure(:mad:)two days after the deadline for the correct month's claim. We can argue about the clarity of T&Cs another day but what I need to get my head round now is this: Does the 40+ day wait between them receiving my claim and informing me that my claim had been rejected give me reasonable grounds for legal action due to their UNreasonable delay in replying?

    Where do you get this from? It doesn't say 45 days in the T&Cs so why give them the benefit of that interpretation?

    Ah, but my T&Cs specifically say 21 days and P2UD tend to hold you to the ones applying when you signed up. The last day for them to receive my correct invoice was May29th. Their letter was dated June 1st. If that isn't unreasonable then I just don't know what is!:confused:

    if their letter was dated 1st june then 21 days would be may 1st. but if it was 28 days that would be 20th april. i would check the T&Cs. mine were V3.1 & that was 14 days to get phone bill to them & 28 days for them to process. i thought that changed to 21 days to get the invoice to them & 45 days for them to process.
    i thought their T&Cs were easy enough to understand. we should know by now that they need us to fail, so have follow them to the letter & only use special delivery. all being well i will receive my last cash back no later than july 5.i wouldn't go out of my way to "buy" a phone from them again but if they had the best offer i would.

    Hi there, Pluckley. Several months down the line I find myself in the same position you were in last year. Did you ever get anything out of those evil little people? I was considering 'unreasonable behaviour' as an opening shot, possibly to the OFT. Waiting 40+ days for a reply is something they shouldn't be allowed to get away with.

    I've had a similar problem with sending a bill in too early. My complaint to them is that I tried to contact them to clarify which bill I had to send in as their Ts&Cs are about as helpful as a chocolate teapot but with no reply. This is the letter I have sent them recorded delivery this week (sorry it's a bit long - once I get going with a rant I can't stop!):

    Dear Alan,

    I have received this morning a letter from you detailing why I would not be awarded my cashback claim through Phones2Udirect. I have to say I am somewhat puzzled and extremely angry as I have fulfilled all of the terms and conditions set out both on your website and the letter you sent me dated 6th June.

    The first bill I received from Vodafone, which I subsequently sent onto yourselves, clearly states my connection date was 30th October 2006. 180 days from this date is 27th April 2007. Why is it then, that when I've sent you six bills, the last one covering the period up to and including the 30th April, has my claim been declined? I also included all of the supporting paperwork required for a claim and sent the whole lot to you via recorded delivery. This was received by Phones2Udirect on 23rd April 2007.

    About a week prior to sending these items to you, I emailed your claims department to verify that I was sending the correct bills to you to avoid a claim being denied. To date, I have yet to receive any reply to this email. So what course of action was I meant to take? Wait for a reply that never comes and miss the cut off date for claims, or send in the bills I am required to within the given time period and be told they are wrong (when they clearly are not)? That sounds very much like a lose-lose situation. Considering I sent these items at the end of April to you, I think it would have been common courtesy to have heard from you before now. If, as you claim, I sent in the wrong bill, then there was ample time for you to contact me and for me send in the next one to you without falling outside the claim period. Instead, you have waited 44 days to send me a letter, just one day short of the 45 days that you promise to send claim cheques out by. Is this so that I do not chase the claim beforehand for fear I may send you the next bill before it is too late and you have to pay the cashback?

    Today I have learnt that there is no way of even contacting the claims department to speak to anyone and I cannot be put through via any other department. You only repsond via email and post. Well I've found out you do not respond via email so I have sent this letter with these details on as well. I find it disgusting that your paying customers cannot even speak to a human being within your department.

    I expect a reply to this letter and my email within the next 7 days or I will be taking this matter further to receive my cashback.


    Sent the email on Friday 8th, and the letter was posted Monday 11th. So does anyone think I have a hope in hell on this one? Is there any chance of getting them on the fact you cannot contact them (and that includes me being insistent on the phone last week begging to speak to someone in claims)? I find it very hard to believe that a company dealing with mobile phones and communication does not appear to have a single phone within one of its departments. Surely Ofcom and trading standards will be able to punish them on the fact they break their own terms and conditions by not paying up within the specified times they state (45 days). So even if they end up paying you, they've broken their part of the deal and you can claim interest back.
  • what did their letter say that they sent you to decline your cash back? because if you sent the bill that arrived after 180 days (27 april) & they have acknowledged receipt or you have proof of receipt then im sure you will win if you go to small claims as you have applied the T&Cs correct. however if you sent a bill received before 27 april, then you wont, even if it said line rental up to 30 april as that is not proof that you have paid up to 27 april yet it is just a bill in advance.
    probably not what you want to hear but you have to be so careful with these deals. i always seek clarification before i order. if they do not respond i dont order, but they normally do when the enquiry is entitled "i wish to order a phone" & i always save the reply.
  • Ye Gods! That's a letter and a half, indeed! I think however, you may have fallen into the same trap as I did, ie. sending the sixth bill NOT the sixth month bill - the seventh actual bill you receive. This is, of course, insane. Most other companies just ask for sixth bill and make it easy for you with forms, coupons etc. The joke is that P2UD then wait 40 or more days before replying thus ensuring you have no time to send correct bill. All my e-mails to them have gone unanswered (surprise!) so I'm off to the OFT and then small claims citing unreasonable business practises. Wish me luck, and if you get a reply to your spectacular missive let me/everyone know!
