    I haven't had any repsonse, automated or human, from them at all to both emails I've sent. It's been a week now since I sent the email and no reply. I'll wait until the letter's been with them a week until I chase it further.

    When I originally sent an email to them back in April asking them to clarify which bill to send in (no repsonse to that, hence cashback now being denied) I also brought up another point in it (no reply to that bit either). Don't know if anyone else has noticed it either. In their cashback Ts&Cs it states:

    To claim each instalment you will be required to send us the complete original postal invoice from your network for the month you are claiming for.

    Notice it says month and not months. Now in my April email I asked if that meant I just had to send in just the 6th month bill and not the preceeding ones. Because they never replied I thought it best to send in all 6. What's stopping me now saying I have actually got one bill preceeding the ones I've already sent them, but that Ts&Cs only state I have to send the 6th MONTH (not 6 months worth) bill to claim the cashback? Really wish I'd remembered I'd brought up that point in April as there would have been a whole new paragraph on that massive letter!

    Has anyone managed to get money from these people? I even filed a small claims court thing which they completely ignored !! What on earth can I do !?!? What comes after small claims court ??
  • I have now had two loss cashback claims from phone2udirect. The first one was due to thier incorrect misleading instructions and the 2nd one which was a phone for my wife, i have followed by the book and correct T&C's special delivery etc for all 3 cashbacks. I have sent all original bills and still no answer - I was out of pocket to the sum of £720.00 for two phone contracts. I have emailed and sent letters to them requesting cashback over the last 12 months but still have not answers from them. I did recently manage to get one cashback on my wifes phone for the 1st cashback which was over 60 days late in their T&C's and came back short of 15p? This was by emailing them lots and lots of times and even to individual email accounts. I am still today after nealy two years and two contracts trying to get cashback back. I have done everything possible and threatened trading standards and small claim court but still no reply.

    Come on MoneySaving expert is there no way that this company can be sorted and closed down as lots of your forum members are having the same problems - no good responses. _ How about a feature on watchdog or a radio station to say avoid phones2udirect - they need to be closed down.

    I'm still planning to get them closed down due to mis-trading laws and breaking their own T&C's. as well as in touch with trading standards and small claims, I have als been on to 02 to also report this abuse of consumer laws.

    Any help or support would be great

    If you email them you should always get an autoresponse. If you don't they will deny receipt of your emails.

    If they haven't paid or defended your claim you can request the court to enter judgement by default. Once you have this you can start enforcement proceedings via a number of routes, probably the best one is to send in the bailiffs. The courts system has a user guide here: http://www.hmcourts-service.gov.uk/infoabout/claims/index.htm


    To everyone else on here, if you have complied with their T&Cs and they still haven't paid then send them a letter before action threatening to issue a claim in the County Court unless you receive payment within 14 days. If they don't respond (and they probably won't), follow through and sue them. It is clear from all the posts on here that they will not pay up until threatened/sued.

    I think that if they haven't replied in the time given by the court you are in fact quite well off, since you a) won't have to attend court but can simply get a ruling in your favour and b) IF you claimed for ALL the cashback rather than just one installment you should be able to get the full amount, since they have terminated your right to claim the rest!

    Good luck - from all that I've read this is one of THE worst companies and anyone who takes out a contract would have to assume that they would need to at least firmly threaten to take them to court!

    Yes - I did a 12 month deal from Dec 2005 to Dec 2006
    They paid up 100% but always late - and I did remind them a few times and threaten court action - but they did pay!

    I have a deal with The Mobile Outlet at the moment - no claim yet - so no idea how they will perform. :eek:

    So would there be any point in chasing them despite having sent in a claim a month early on the grounds that they are just completely unwilling to communicate with their customers, to the point of ignoring them? If my initial communication to them was regarding the terms and conditions about making a claim and they then do not reply and consequently my claim is rejected, do I have a case? And their delay at telling people their claim is rejected (i.e. past the point at which they could send in the correct bill) is blatently so they don't have to pay out. It all smacks of very poor business practice and they should be pulled up by someone official.

    If I don't get a reply I'm going to Citizens Advice. And I actually work for the Beeb so I'll see if an internal email to Watchdog does the trick and chase them to hound Phones2Udirect!
