I wonder if any of you can help.
About 6 months ago my wife signed up to Three through Phones 2U direct. They were offering 100% cashback, reclaimable at 3 times throughout the 12 month contract.
She has just submitted her first claim and has received a letter stating that they are unable to process the claim as 'the bill dated 01/04/07 is incomplete'.
However, she has a telephone bill that shows that she was on the phone to them for nearly 10 minutes and someone confirmed that everything she was sending them was correct. Unfortunately she doesn't have their name.
I know that there are risks with these cashback claims and that you have to get everything right as they can reject the claim (I've used Dialaphone in the past and they've been excellent).
Has anyone else had problems with them (from other forums it would appear that this is a regular cause for complaints) and if you have what have you done to get your money back? She has informed them that she will be contacting Ofcom and trading standars and I was wondering if there was anyone else who could help.

Oh dear; one of the three WORSE companies should could have gone to I'm afraid. You should ONLY use this company if you EXPECT to at least threaten to sue by all accounts. There is a LOT of feedback on this company - and just about all bad - on here. I suggest you start searching and reading and ask for further advice on the relevant thread!0

Without asking you to relate all the details, you should make sure that you are in the right or firmly think that you are.
Continue to call and email them - keep copies of all your emails and note whether or not you get any reply (even auto responses). Give them time to reply and if they do not, then take it to the next stage.
Use the small claims court but tell them you are doing this first. If you really think that you are correct, then the judge will see that. The district judges tend to be pretty on the ball in these cases and if the company defends the case, they will give you plenty of time to argue your side.
You can claim the whole 12 months cashback plus the legal costs. It's a long process but worth it in the end.0 -
I have been fighting for my first cashback for a while now, second one is due in now and have just been told that 'word on the street' is that they have gone bust. Apparently the previous company associated with them also went bust. :mad: Am having this information double checked and will let you know if I find out anything different.0

The other two that immediately spring to mind would be The Mobile Outlet and Mobile Rainbow. But there are others who I would also be extremely wary of; Phones4u, Buymobilephones (this one MIGHT be ok IF they didn;t only allow 14 days to claim from the bill date AND told you that BEFORE you make a purchase!) and anyone without a decnet track record. Not hard to find lots of feedback on the worst companies - though there's a lot of bad stuff relating to the better ones too. My criteria are 1) t&c doable - e.g. at least 28 days to claim from bill dates and I understand EXACTLY what is required, 2) good cash-flow and maximum Quico; 3) Although prepared and able to sue and would have a good claim general feedback suggest I won't have to (e.g. most of those angry reviewers didn't ACTUALLY follow the t&c!). A lot of research and careful reading goes a long way!0

Also, does anyone have the text they use for a successful small claims court action against them (with personal references removed of course).

Any one like to offer text for a successful small claims court claim...
What is the exact name of the company, address and company registration number - I recall there being a number of similarly named companies, where people making a claim could choose the wrong company to make a claim against.

Hi,
I recently filed a claim on the MoneyClaim website for my 12-month contract with Phones2UDirect. Like most people, they have ignored my emails and phone calls as well.
I would like to know if others have filed a claim recently with the small county claim court and been successful. I say recently as the above post about the company going bust doesn't sound too good..
