I recently filed a claim against Phones2uDirect with Money Claim Online for none payment of my third cashback installment. They did not initially respond to claim, so I was advised to enter a judgment. Unfortunately on the same day I entered judgment (two days after they where supposed to respond) they filed an Acknowledgment of Services intending to defend part of this claim.
I assume Phone2UDirect will now make an offer part payment in the assumption I will not go all the way to court. Is this a new method Phones2UDirect use to wiggle out of cashback payments?

I am also a 'victim' of this company. Reading anpictum's post I wonder if the Ts & Cs can be challenged on the unfair basis? Anyone tried yet?
I sent a Letter Before Action, and their reply states:
"you only sent us the first page of a 4 page invoice. ...as the billing layout varies from network to network we ask for the complete invoice..."
The first page tells them that I have paid to date and have no arrears. Of course that's not enough!
I will take some more advice, but on the day I suppose it depends on the judge.

on my case after sending two letters and various e mail's they have paid me the second claim on 19/07/07 which is almost delay of 2 months... i am still waiting for my last payment...moral of the story is don't buy any more phones from them and keep trying if you have done everything according to their terms and condition they will pay......my last cheque also proves they are still in the business and are still playing the old games.

- The date your claim was issued.
- The date the claim was sent to the defendant and the date it will be deemed to served. In my case this was four days after being posted.
- The date the defendant has to reply. (Usually 14 days after the claim has been served).
- Pay the total claim including the £30 costs
- File an acknowledgment of service. This allows the defendant an extra 14 days from the date of service to file a defence
- Dispute the whole claim
- Admit that all the money is owed
- Not replay at all. This is when you ask the court to enter a judgment
- Defend all of the claim
- Defend part of the claim
- Intend to contest jurisdiction
I followed the t&c to the letter and knew Phones2U where in the wrong. I would have been prepared to go to court as I sent all claims and letters by recorded delivery, within the correct time scale.
