  • I have been reading these message with great interest as I am in a similar position.

    I received my first cashback after several letters, but my second and third did not turn up despite several letters.

    I took court action as explained by Cook!e on Monday. This morning a cheque turned up for the cashback claim plus my court costs.

    It appears that phones2udirect will ignore all correspondence and will not make payment unless you take court action.
  • My first bill comes on 13th, DEC, 2006. I sent out my first claim after I received my 6th bill on May 13th. Then after nearly 45days a letter came on |July 3rd from PHONE2UDIRECT saying that they need the bill of June. Then I sent out the bill of June immediately the following day. On August 25th, I received another letter from PHONE2UDIRECT. They told me that my application was unsuccessful because the 21days deadline expired.

    Here’s the original letter:
    Unfortunately we will be unable to process your cashback claim for the following reason:
    1) Your network invoice dated 13/06/07 was not received until 10/07/07 and was too late to claim. Due to the above issues we are now regrettably unable to process any further claims on this account,as per the terms and conditions agreed by you at the time of application, which state where a cashback is claimed in instalments; claims for subsequent instalments are dependent on acceptance of the previous claim.

    I had never seen on the contract once you failed you can’t claim anymore. It’s just his own explaination. I doubt the sales and claim and whatever are just one person.

    How did you get on with this? I am having exactly the same problem right now with phones 2 u direct.

    I got a letter rejecting the claim, I have written to them (email) and explained the situation, the I never received a postal invoice from them to send, and I sent what I considered to be my invoice at point of purchase.
    I pointed out to them that the T&C's do not make it claer that it is a postal invoice that need to be sent in, and that no metion of the fact that your sim should be attached to the invoice that need to be sent in.
    Also reported it to the Office of Fair Trading and Three (the moblie network) . have to say the response fro Three was terrible.
    Gave them 7 days to reply.

    Will let you know what happens but I'm not hopefull.

    Seems not all they say is true, they admitted I was right, it seems that the don't attach Three Sims to their Invoice. They are still saying that the invoice was posted with the phone. Now I'm just waiting for the Trading Standards Officer to contact me, before I decide what to do next.

    The purchase invoice would have been with the phone in the Royal Mail bag that was delivered to you.

    It is a legal requirement to supply you with a purchase invoice with the phone and due to the way in which our despatch system is set up we ensure that every item is sent out with an invoice.

    With most networks we will attach the SIM card to the invoice however this is not the case with the Three network so we apologise if you have been told this.

    The email that is sent to you when you make your order is a confirmation email that confirms we have received your order. It is not in any way an invoice.

    As stated in our previous email our customer services team would have been able to clarify anything you did not understand either on the phone or by email.

    In conclusion your claim has been rejected correctly due to an error made on your part and we feel that there is nothing further we can discuss.

    I have posted my bills for my first cashback in May 2007 and still waiting to hear from them. I have also posted my second cashback in Sep.
    Phones goes on ringing...no one answers..emailed them several times- to sales, claims & chequebacks - no replies.
    Can anyone tell me how to get the money back.. £420 at stake..:confused: don't know what to do?
  • I got my final cashback from them today. It was several months late...but better late than never. I sent them a letter by Recorded Delivery and threatened legal action....I gave them 14 days to pay up, and they paid up within a week. If anyone wants a template I will be happy to supply it. Thanks


    Could you please post the template. I think we need to go down that route.

    That's odd, they told me that they had a problem with their phones and that I was the only customer who claimed that I couldn't get hold of them.

    I really must pop round and see what their operation look like....
  • I've also been a victim of this bunch of thieves, Phones2udirect.

    I'm now just sending off my 3rd and final claim on a 12 month contract. All have been sent recorded special delivery and in accordance with their T & C's.

    However, I've not had a single cent in payment despite numerous threats and reminders. They will not even confirm or otherwise whether my claims are valid.

    As I am now just sending off the 12 month claim, I suppose I may as well wait the 45 days to take legal action for all three payments together.

    This is just too much hassle - AVOID - next time I think I'll forget the cashback and stick with "Three" or something similar.

    Is anyone getting paid out on their claims?

  • Why wait? Don't their t&c say lose one lose all claims? If they haven't paid and you successfully sue you'd recover all the money in one go. Although I agree ALL these companies are now very dishonest it is still possible to make a success of totally free deals. But you definitely chose one of the worse companies! If you ever do consider another cashback deal, do a LOT of research first next time. I currently have 9 totally free contracts and have got many more for friends and family - we have never lost a single claim, but you really now have to know more than ever before exactly what you're doing.
