    This depends on circumstances. How old is the garment and does she have proof of purchase?

    Had a nightmare of a day!!

    We ordered a new bed from TJhughes online, first they delievered the wrong size, so i refused to accept and they responded very quickly and delievered the correct size the following day.

    Upon construction we discovered the have sent completely the wrong part to construct the slated base. After many phone calls and promises to ring me back today, nothing has been sorted they are trying to blame the manufacturer and fob me off to them, i know it's tj hughes who should be sorting this problem out, but they have been skirting around finding an actual solution. The manufacture actually phoned me this afternoon after recieving an email for tj and said that they have already told tj that there is a problem with this batch of beds, also he said that they will not have a replacement part until late next week when the shipment arrives. this is no good for us, we have no bed at all and have had to sleep on the mattress only for the last 2 nights.
    As i see it this bed is faulty and not fit for purpose as it is. my question is can i get a full refund even though we have disposed of the very large boxes it was delievered in ?
    i brought this bed online, cost £455 and paid with my debit card , if that makes any difference. please help if you can, im knackered !

    How long have you had the bed?

    If for less than 7 working days you can cancel for no reason at all, and as the bed is faulty, you will receive ALL your money back, including any original delivery costs.

    As the bed is "not fit for purpose" you can cancel under SoGA.

    Both options dictate T J Hughes uplift the bed and refund ALL costs, any problems then you can also involve your CC company as they are jointly liable under Section 75.

    The disposal of packaging is totally irrelevant.

    Thanks Derrick, the bed was delievered last saturday, so 4 days ago. Have spoke to them AGAIN :rolleyes: just a minute ago, and explained that if they dont deliever the missing parts by tomorrow i want a full refund, so will let you know what happens next! Tis

    Delivered "last Saturday", 17th? If so it is only 1 day, the 7 WORKING days start the day AFTER delivery!

    Have a read of this, in particular Pages: -
    17, 3.23.
    20, 3.26.
    25, 3.48.
    27, 3.55, 3.56, 3.57.
    28, 3.58, 3.59.

    I have tried writing to them, and had no response. I've tried phoning on several days and there is no answer at all.

    Sounds like they may have disappeared. If you phone Sheffield Trading Standards they may be able to tell you if they have had similar problems to yours. Worth a try.

  • hi - my mother put a £100 deposit down last weekend on an outfit for a wedding from a little boutique - in the meantime she has found something else!! The owner is denying her the deposit to be refunded - does anyone know if she is entitled to it back?

    So long as no goods were ordered specially for her she is entitled to her deposit back.
