But if you look at the stock is says "ALL DISCOUNTED ITEMS ARE NON RETURNABLE, EVEN WITH THE USE OF A DISCOUNT CODE"

Which is in fact illegal is it not ?

They seem to have it right according to their returns policy.

Not on their sale items: http://www.motelrocks.com/showItem.php?stockCode=53119

I called them just to make sure and they confirmed that sale items are non-returnable, due to being end of line stock that they are trying to shift, they can't accept refunds on them

Edit: Deanos beat me to it!

Even if its on sale you can still return it, not under there 14 day terms but under the DSR which is 7 days , i would report them to trading standards

But surely their T&Cs will take precedence over certain pages, and as we all know, Statutory Rights take precedence over a companies T&Cs, even MotelRocks agree, from the page I linked to; - "This Delivery & Returns policy does not affect your statutory rights as a consumer."

Their returns policy, as linked to above, conforms to DSRs.

I think because they have clearly mentioned it on the site they can get away wth it as per OP's experience, how many people would just let it go, it does need reporting IMO

You would like to think so, however the last time I tried to get a refund on sale items I had to do a lot of arguing and explaining about DSR before they eventually agreed. They didn't know anything about DSR though. And they shouldn't really have the notice that discounted items are non-returnable because it's completely false!

Well they do according to the page I linked to above (my emphasis); -
    "Canceling an item:
Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item within seven working days of delivery"

  • Hello!

In June I purchased a Net book from Curry's. I paid the £179.99 using my Maestro/Switch card.

Since then it broke and it got sent make to the makers of the Net book (HP) They fixed it and sent it back.

Now it has broken again which seems to be a different fault.

I only use the Net book occasionally and mostly use it to store a few pictures on etc.
I am not pleased I have a product which has broken twice since I purchased it in June.

I would like a refund for this product, As it stands I cannot use the Net book at all. As far as I am concerned it is not fit for use.

Only problem is when I took it back to the shop the guy serving me says I will not get a refund, I have to get it sent off to HP to be fixed again or nothing.

I just spoke to Curry's customer Support who said I would only get a refund if the Net book broke 3 times with the same fault. (I think this new fault is a different fault to the first one)

Am I entitled to any kind of a refund? I cannot use the product currently, It's the second time it's broke down sins I bought it in June. I am unhappy with it and would like my money back.

I have a manager phoning me back in an hour, But apparently they will only tell me what I was told by the guy I just spoke to at Customer Support.

    Help!
  • Hi all,

Any help on this would be much appreciated.

I bought some designer sunglasses about a year ago,

from a well known high street store. A few weeks ago I noticed that they
had become slightly loose, so decided to take them in to one of their branches
to get them tightened up (I didn't trust myself to do it!). Although they
appeared slightly better afterwards, they quickly became loose again and
also felt wonky. I then decided to take them in to another branch. The sales
advisor here told me that the frame had actually been bent and thus there
was little that could be done. This leaves them basically unwearable as I
can't wear them without them falling off and not sitting correctly. I am
sure that it was the original sales advisor that bent the frame
while trying to tighten them, or I would presume that she would have told
me that there was a problem when I took them in.

I've written a complaint, and have received a response that the store
manager would like me to go in and show them to her. I am planning to do
this, but am unsure what my rights might be. If we can establish that the
sales advisor did break them, and they indeed cannot be repaired, should I
expect to be offered a new pair of similar value/a refund?

Thanks for any help you can give me.
