This is what they state, "Refunds will only be given on postage whereby the equipment has been returned in the first 30 days due to the items being faulty. No other refunds on postage will be given. Please refer to our returns policy."0 -

Their T&Cs do not take away your statutory rights,in this case DSR and SoGA.
Under DSR you have 7 WORKING days beginning with the day after receipt of goods to return without reason and ALL cost are to be refunded including original P&P
See page 17, 3.23. and page 27, 3.26.
Have a read through Section 48 of SoGA, they cannot charge you P&P for wrongly delivered goods.
As I said earlier, they did not deliver the ordered goods, so IMO, they cannot cahrge you the premium delivery service!Don`t steal - the Government doesn`t like the competition0 -

They sent you the wrong item, postage costs are down to them whichever way they want to pay it.
Section 48B, 2 (b) from the SoGA link above; -
" bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage). "Don`t steal - the Government doesn`t like the competition0 -
Having major problems with currys whatever happens policy,
i took this policy out on a tv at the time i was told that if my telly breaks down, gets damaged etc i can get a new one, my tv has broken down...so lets begin..... call on sunday.....please call during office hours.....phone again monday, they will send some one out wednesday
took wednesday off work, first (wednesday) they sent a man at 6pm, thats it no tools just a man...he told me my tv was broken and needed to be repaired.....he ordered every part available for the enginer to bring when he arrived, took friday off work ,the enginer arrived (friday) with every part..... he changed one part...told me my tv was broken and needed to be sent away......arranged for tv to be taken away on sunday but also gave me a number to call saturday afternoon to get a two hour time slot, phone number didnt work it was for getting tvs delivered not picked up and was all automated, phone sunday morning for my 2 hour time slot....response....some time between 9am and 4 pm.........guy arrives.......3.45pm......takes tv and tells me they have a 48hour turn over so it should be back by end of the week......no replacment tv.......phone about replacement tv.....policy has changed and i need to be a plus member to be entitled to a replacement tv....not informed of change.....not policy i was originally sold.....end of week arrives....no tv....phone again......shouldnt have been told 48 hous can take up to 21 days!!!!!!!!!!!!!!! phone every 3 days for an update....answer always the same it still being looked at......phone again on the 19th day.......guy tells me it hasnt been looked at yet and is still in the warehouse....i request there 21 day write off for a new tv.....cant do that till monday....girlfriend phones monday....tv has been looked at and new parts are being ordered.....tough we want a new one.....put through to case department.....wont talk to girlfriend needs to be me.....i phone when i get home from work.....write off is agreed i should get an email within 24 hours with voucher number for new tv....24 hours passes no email.......go into currys sales guy phones....is told i should have been told 48 hours i agree to return in 48 hours.....48 hours passes......no email....i return to currys....no write off was done when i requested because no email wasnt sent DESPITE THEM HAVING A PRINTED OUT LOG OF MY REQUEST 2 DAYS BEFORE, i get angry, he phones loads of different people trying to resolve....finally he is told.......its USUALLY 48 hours but could be up to 5 days!!!!!!!!!!!!! Every one i talk to has a different time frame.......the policy i bought was changed without me being told (no replacement tv) the goal posts are constantly being moved to suit them ITS A JOKE!!!!!!!!!!!!
£169.99 for the policy, £90 a day for the 2 days i took off work, a 5 year old driving me mad because we have no tv.......

Can someone confirm something to me. If you bought a used car under warrenty and it developed faults early doors am I correct that oppurtunity has to be given to rectify faults using manufacturers warrenty (ie not at your expense) and only if they are not fixed or re-occur later down the line- 3 months etc- you can reject the car under SoGA?0

The Consumer Advice article on Private Car Sales states that it is reasonable to expect that a car will pass an MOT if it is sold with a valid MOT certificate. Does anyone know if there is a legal precedent for this?0

in 1996 i paid a dial-up internet service provider to get a years internet access over the phone. the deal was pay a year in advance for the service, there was no contract, by implication the service would be withdrawn if i chose not to pay on the next billing date, a year later.
Now 13 years later, broadband has happened and i have ceased to use the old dialup service (i use a completely seperate broadband provider), but I kept up yearly payments, mainly to keep my old email address.
In 2008 i decided that it was no longer worth renewing the dialup, I hadn't used the dialup facility for about 4 years, but kept checking the mailbox (via smtp from my broadband connection) to pick up the dwindling emails, so when the invoice arrived in Oct 2008 I didn't renew.
Last week I received a letter from a credit account recovery agency, seeking immediate recovery for a years balance (£145), threatening formal debt recovery and legal action. (the last payment that I made would have taken me up to oct 2008)
I have phoned the service provider (who are now a part of Kingston Communications) and they were extremely reticent about canceling the supposedly owed amount. Saying that they would 'look into it' - As far as I'm concerened there is nothing to look into, I have no contract for the supply of services, and haven't used the primary aspect of the service; internet access, although I have regularly checked the mail, partly to see how long it would take them to delete the account.
I should add that I never actually notified them that I wasn't going to renew.
I am thinking that this may get 'interesting' - so to be forewarned, has anyone got any advice on where to find out my rights as a recipient of an unwanted service? if thats what I am.0 -

sorry that sounds like nonsense
so a car passes and mot and should be expected to pass an mot for anther 11 months and 30 days?
