Hi hope someone might be able to help.

My son's girlfriend has an ipod. The hard drive seems to have gone and the apple shop don't want to know. It is 23 months old - should they fix it for her or as it is over a year old is she stuck?

Under the Sale of Goods Act, you can claim a remedy for faulty goods (e.g. repair) for up to 6 years from purchase (5 in Scotland, because apparently the Scots get sent things which don't work as well ;)). Your first course of action should be to contact the retailer where you bought it, mentioning this. They are within their rights to ask you to prove that the fault was inherent with the ipod and not caused by misuse/accidental damage. With an ipod, this latter point will be harder to prove, as it is often carried about in bags, pockets, etc.

But first up, write to the retailer explaining the situtation.
    Squirrel!
If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Firstly an inherent fault in a product that is 2 years old is unlikely. Secondly, a technical report trying to prove this can easilt cost around 100 GBP and has to be balanced with the cost of the item in the first place.

  • Hi, can anyone help ... I bought a hotpoint electric oven last August and last September it started making funny noises so a hotpoint engineer came out and fixed it under warranty. Now it has started to overheat and burn things but hotpoint want to charge me £100 to send an engineer out or £16.99 a month for 10 months for another years warranty.

What should I do ... take it back to where I bought it (b and q), get a local engineer in to fix it or go with hotpoint.

What are my rights here under the sale of goods act?

    Thanks.

It was your responsibility to check the TV was suitable for the purpose you bought it for. Nobody else would have known your intentions.

Not sure I entirely agree with Art. Yes, if the TV is not compatible then it is your own responsibility. But is this the case?

It sounds as though the TV may be faulty if it works for a while before cutting out.

Hi I wonder if someone could help me with my little problem.

my wife and I got married in April 2008 and we had a dualit kettle bought for us from debenams as a present, yesterday we found that the kettle has started to leak badly all over the base, looking on the net its a very comon fault with this model.
my wife rang dualit and as the kettle was made in 2007 all the could offer was 40% off a new kettle! where do we go from here back to demenams (we dont have a recipt) or battle it out with dualit. it seems to me a kettle costing about £70 should last more than a 18 months. infact our last one cost £20 and was still going strong after 5 years!

    Thanks in advance

Technically it is the purchaser of the kettle, not you, who have the rights. The problem is for Debenhams to sort out not the manufacturer.

Best advice is for you to ask the purchaser to contact Debenhams. They will need a receipt or proof of purchase. If this is a known problem with the kettle it should be rejected as having an inherent fault as it is not suitable for purpose.

Hello, please can someone help? I dont know if i have any rights here...but i was viewing an item in the sale on a well known clothes retailer website (i think it might have been 50% off). when i went on to purchase the item i noticed that it has gone back up to full price with no mention of it ever being in the sale! Is it up to them what they charge or do they have an obligation because the item was in the sale for a period of time? I cant seem to find any information on this so if someone could point me in the direction please that would be most appreciated!
