I noticed that Alie Bongos Mum and chimp14uk have had trouble with Littlewoods trying to avoid honouring the price at which items were ordered on their website (or their subsiduaries). I also noticed that Art had given useful advise on the subject. As I am now in a similar situation myself with Littlewoods, I wanted to know what the latest state of play was in your complaints and if anyone else has had similar experiences.
My reading of the situation is that once they've taken payment then they have legally entered into a contract, despite and in contradiction to clauses 2.2 and 3.2 (see below) of their T&C's. Is this correct?
I placed an order on 18th July and the payment is described as pending with my credit card company (I'm presuming that this means Littlewoods have asked for the money and my cc co are just doing the usual security checks). I can see on their website that my order status is "Order Accepted", but they define this differently in 2.2.
So, just wondering how you are doing with your claims and if you have any advice you can give me.
Many thanks
T.
Have they refused to honour the price at this stage?
The 'payment pending' status simply means they have effectively reserved the payment with your cc company and as you say, the normal procedure is for it to be released to them on dispatch.

Hi Art, no refusal thus far but given chimp14uk and Alie Bongos Mum's experiences I'm not expecting this to be all plain sailing.
I'm hoping that the posters on the other forum are giving me accurate info regarding payment being taken. The only noticable difference is that I think they paid on debit cards, were as I paid on credit card. I'm hoping the payment is taken this week, otherwise I doubt I will get the item at the price stated.
I have also read negative comments relating to prices being so low as to make it obvious that it's a mis-price. In such cases, people have suggested court claims would be declined. Is there any legal background to this? The item I'm hoping to acquire is a bicycle which is now retailing around the £250 mark. The price I paid is under £50, but as you know some cheap bikes sell for around the £50 mark.
Thanks

This is a difficult situation. I would wait until they either dispatch the bike or refuse to do so. Let us know when something happens. Have they given you a date yet, and are they showing it as being in stock?

Go back to Currys and ask them to repair or replace the unit. Tell them you expect it to last longer than 16 months and under the Sale of Goods Act they have responsibility for up to 6 years. The unit is not fit for purpose.
