Tell the retailer there is an inherent fault with the ring and you want it replaced or your money refunded under your rights in the Sale of Goods Act.
PS thanks for your prompt reply Art:D0 -

As the ring was under 6 months old you do not have to prove there was a fault with it. They would find it very difficult to prove there there wasn't a fault. They may try to say you've damaged the ring so be prepared to deal with this.

The retailer has a right to verify that the goods were bought from them. If you can't find the receipt then a credit card statement or a cheque will be just as good.

hi,
Last week, I bought a ghd from puresilky.com, not realising that its fake. I only realised it when I failed to register it on GHD site. Now, how do i get my money back, the trader does'nt respond back to any emails/messages, site does'nt work anymore and there is no other way to reach. (I payed through paypal and i do have the shipping details with his account details with city link couriers) Can this be tracked through payapal records or city link records???? How do I get a refund?
Pls help!!0 -

Lodge a complaint through the official PayPal dispute procedure. Was the purchase from ebay? If so notify them also.

Hi all
I noticed that Alie Bongos Mum and chimp14uk have had trouble with Littlewoods trying to avoid honouring the price at which items were ordered on their website (or their subsiduaries). I also noticed that Art had given useful advise on the subject. As I am now in a similar situation myself with Littlewoods, I wanted to know what the latest state of play was in your complaints and if anyone else has had similar experiences.
My reading of the situation is that once they've taken payment then they have legally entered into a contract, despite and in contradiction to clauses 2.2 and 3.2 (see below) of their T&C's. Is this correct?
I placed an order on 18th July and the payment is described as pending with my credit card company (I'm presuming that this means Littlewoods have asked for the money and my cc co are just doing the usual security checks). I can see on their website that my order status is "Order Accepted", but they define this differently in 2.2.
So, just wondering how you are doing with your claims and if you have any advice you can give me.
Many thanks
T.
T&C's:
2.2 When you submit an order to us on our website you will receive a 'bounce back' confirmatory email of this order saying that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors. Neither of these emails constitute acceptance of the order by us. Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you. Title to the goods will pass to you on delivery.
3.2 Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.0 -
If payment is pending then it hasnt been taken0

If payment is pending then it hasnt been taken
Thank you Deanos for your obvious and somewhat expected comment but I expect this will go through any day now. I have discussed this on a different forum with people who also ordered the item and they have seen the amount taken from their accounts. If this doesn't happen for me, I'll eat my hat.
Assuming I'm right, would anyone like to comment on the legal position once payment has been taken? The cases I referred to Alie Bongos Mum and chimp14uk were found in this forum and date back to June.0 -
Just because its pending dosent mean they will take the funds, ive had amounts pending in the past but later they have been sold out so money was not taken, was a few years ago mind.0
