    This would be a long drawn out process to challenge. Initially you could contact your MEP to see his views and see if he can help.

    This will not be covered under the guarantee but if you have an extended warranty you may be in luck. Check the conditions in the warranty.

    If you try to tell them a lie about the reason the laptop isn't working you are likely to get found out when they come to look inside.

    I'm hoping that someone will be able to offer some advice. I bought a Beko fridge freezer online from Curry's which was delivered in November 2006. I didn't take out the extended warranty, but have had no problems with it until last weekend, when it started making loud noises, and then clicking, and the food is no longer being cooled/frozen. My partner thinks that the motor might have gone, which after 20 months seems a bit soon for a fridge freezer.

    I rang Curry's helpline this morning, and was told that because we don't have a warranty, we would have to obtain an independent engineer's report to show that the problem is due to a manufacturing fault or defect before they will repair it.

    Does the Sale of Goods Act give me rights for a repair or replacement, or should I have taken out the extended warranty - any help will be much appreciated!

    You can go back to Currys under the 'reasonability' clause in the Sale of Goods Act. It is unreasonable for something like a fridge to break down in 20 months. Tell them if they don't deal with it you will go to the Small Claims Court.

    Just to let you know how I got on with their customer services.
    They came back last week saying there was nothing else they could do so I asked for the name of the chief executive. I sent all the details to her on Friday by email and I said I would involve Barclaycard, and the small claims court if I didnt get a reasonable result. Had a phone call today to offer a full refund at the contract price, not even the 20% off price I actually paid plus a £50 voucher to spend in store and photos of the day (that I didnt know they'd taken) for all the children.

    Very pleased with that, thanks for the advice.

  • my mum brought a suitcase from our local high st
    when she got home i checked the suitcase and found out eh suitcase does not close and the key locks don't work.
    got my mum to go back for a refund and was told that we cant have a refund.
    i want to report the shop to trading standerd so decided to see what the company info and can't seem to find it(even checked www.TheCompanyWarehouse.co.uk )
    the company name on the receipt is JR BAGS and the add is 21 high st north, east ham.
    is there any way i can get a refund or report them for this

    Under the Sale of Good Act you are entitled to a full refund as the goods are not fit for purpose.

    I suggest you go to the shop and inform them of their liability. If they won't comply contact your local Trading Standards Dept and ask for their help.

I noticed because it caught on my sons clothes when I was dressing him. I took it back to the jewellers who said they had to return it to the manufacturers to check if it was their fault 'or not'.
    I didnt argue until the sales girl said if it was a manufacturing fault they would repair it. I said that as it was only two months old I would expect it to have lasted alot longer and would want a replacement. Another sales lady interrupted and said it would be replaced, but the first sales girl who was possibly new as she kept asking a supervisor, said that she had been informed to find out the cost of repairing the ring.
    Anyway its gone off to be inspected and Im to collect it and find out the results tomorrow (Thursday first thing). Late as it is can anyone advise me in very simple terms of my rights so that I am prepared for an argument (you know when you just get that feeling?!) Anyway heres hoping someone out there is still up and still online :D

    It is the retailer who is responsible and not the manufacturer. Tell the retailer there is an inherent fault with the ring and you want it replaced or your money refunded under your rights in the Sale of Goods Act.

    If they insist on a repair tell them that if a similar problem occurs again you will only accept a replacement or refund.
