    There seems to be 3 important documents that are being referred to:The Real Deal,The Small Print and the Price Plan,they all say different things,which one can they dictate is the T&C's?
    THREE ARE USING A NEW APPROACH I GOT A BUSINESS CONTRACT AND AT THE TIME I TAKEN THE CONTRACT IT WAS FIRST SECOND BILLING AND TODAY IT FIRST SECOND AND ON THE 23 SEP 08 IT GOING TO BE FIRST MINUTE BILLING.I JUST COUNTED I HAD 95 CALLS UNDER A MINUTE WHICH IS DETRIMENTAL TO ME SO I WROTE A LETTER AND GOT THE REPLY......Thank you for your email about first minute billing and requesting cancellation of your account.

    As discussed with my colleagues yesterday, we are unable to cancel your account for this reason. Our booklet named The Real Deal states the following. I have attached a copy of this for you.

    This has all the info in the Footnotes on page 35 of the document which carries the following information:

    For customers other than those on Mix & Match, Business Mix & Match, Video Talk & Text 700 plan and Video Talk & Text 700 – £5 content the calls will be billed per second from the start of the call for a promotional period (until) 22nd September 2008. For customers on Video Talk & Text 700 & Video Talk & Text 700 – No £5 content, from 3rd August 2008, all calls made (except to short code, premium rate numbers) will be initially rounded to the first minute and will be billed per second thereafter. The call duration will be mathematically rounded to the nearest second.

    This is only applicable to customers who have purchased/upgraded after 25 October 2007 although this has not been implemented until this month for some customers.

    As this has now been discussed both verbally and by email, we now consider this matter closed.

  • Thanks for bringing this to my attention. I had no information from 3 about them introducing a charge for paper bills. I've now changed to e-billing.
  • On My Conversation With One Of The Customer Services He Told Me The Real Deal Tc Were Given To You In The Mobile Box I Went Home And I Checked They Was No Such Booklet So I Phone To Find The Lying Rat He Was Unavialable To Speak To Me.the Real Deal Is Just Made Up This Week Because When I Rang Them I Told Them Are You Going To Implent Any Changes She Told Me To Wait And Said I Going To Check For You And Then She Came Back And Assured Me That The Change Will Not Effect Business Tariff, Then The Letter Came On 20th August First Minute Billing.i Just Lodge A Complait With Otelo And They Adviced Me That You Have A Good Reason To Cancel The Contract And He Told Me It Eralavant To You Regardind Real Deal Cos The Change Is Going To Be Implemented And Will Affect You.
  • Has anyone managed to successfully cancel a contract that was renewed after they 'introduced' the changes back in November 07?
    I was unfortunate enough to renew in Jan 08 and apparently three are allowed to start charging me for the first minute calling.
    My letter also states that they will be introducing charges for the itemised and paper billing. I have argued that this is a detrimental change to the agreement but they won't budge (even when I've got them to acknowledge that I'm worse off). I'm sure I've racked up over 4 hours of calls to them.
    One adviser stated that this was an additional service that falls outside of the term of the contract and therefore they can charge for this service that was previously free. I don't buy it and they won't budge!!
    I've written the letter to 3 which I had a response to on the phone (a call that lasted 1.5 hours) where I again argued that the changes were detrimental to me. Although he (finally) agreed, he kept going back to the fact that the call charges were always part of the contract - even when I was talking about paper billing. Now I'm supposed to wait for a call from his superior...

    I can't see if anyone has successfully managed to cancel a contract that was taken out after November 2007 - and if they did on what grounds?

    BTW - I need itemised and paper billing (which need to be originals - not copies) to give to the accountant and HMRC - I don't wish to be charged for something that I assumed would be provided for the duration of my 18(!) month contract.

    The Dec 07 "The Real Deal" aka The Price Guide, which would be applicable to me as I upgraded in December, has the footnotes on page 30/31 with footnote 15 mentioning the changes with regard to first minute billing - but I cannot see anything referencing footnote 15 to my pay monthly contract anywhere, it's only referenced on the Pay As You Go Flat 12.

    Footnotes are on page 34/35 of the current Sept 08 "The Real Deal", and footnote 15 is correctly referenced on the pay monthly page too.

    I would say an error omitted the footnote reference on the pay monthly section of the Dec 07 "The Real Deal", therefore meaning the footnote is not linked to the conditions as it's not referenced?

    Btw everyone, please don't mention anything about deadlock reference numbers to three. They do not exist, what you want is a deadlock letter. The exec office basically said that they are something made up by people on this forum, so it would be in our best interests not to mention a reference number.

    i've given up - i've tried every conceivable way and just ended up getting nowhere. I think there's more to the 'direct debit' cancelling than meets the eye because i don't think any company would let you out of a contract if you tell them you can't pay it through the bank - they'll still expect you to pay it.

    they've declared i received the terms and conditions when i upgraded in december(i didn't) and no amount of arguing will change them from that standpoint.

    so i surrender ..
