Summary of what I've learned:
If your contract started before October 2007 and you haven't changed it, renewed it or in any way triggered a flag stating that your terms have changed; you will get a cancellation (or an upgrade) if you ask the right people.
The best course of action is to email executive.office@three.co.uk and copy enquiries@otelo.org.uk. Don't be bolshy, just state the facts:

Dear Sir/Madam,
I have today received a letter from you with regard to changes in the charging on my contract due to be implemented on the 23rd of September. Specifically the rounding up of seconds to a whole minute.
A lot of my calls are very short, and often I just ring 3 Voicemail to delete messages left by people cold calling, without even listening to the voicemail. This change is going to be an extremely detrimental variation to my agreement and, having read the terms and conditions of my contract, I am giving written notice that I wish to cancel my account.
I’ve taken the liberty of copying the relevant paragraph of the Terms and Conditions below. Section 10, Paragraph 10.1d
d. Within one month of a detrimental variation to your agreement. You can end the agreement within one month of us telling you about a variation to your agreement (which includes your Price Plan) which is likely to be of detriment to you. You must give written notice to 3 Customer Services within that month and your agreement will finish at the end of that month once we receive your notice. (A Cancellation Fee will not be charged.)
In addition to the cancellation, I wish to keep my number and would appreciate your supplying me with a PAC to transfer the number.

The executive office will reply within a few hours to say they have your email and will be in touch within 5 days. You will then get a call within that timescale and they will tell you that your contract is prior to the changes and you can cancel, or upgrade.
Listen to what they have to say and makes yer choice.
I swapped from my Texter 15 plan (100 texts and 75 mins I think) to Mix and Match 300 - same price, new contract for 18 months, new Nokia N95 being delivered tomorrow.:T
The lady I spoke to was calm, clear and polite, at no point did she pressure me or cause any offence. She answered all my questions and even suggested I take a while to think about what to do before calling back (this after I had said I wanted to go for an upgrade :cool:)
I don't like 3 customer support and hopefully I won't have to deal with them again, but their exec office is the nuts.
If your contract is after October 2007. You might get lucky, but I'd expect a lot of flak, they seem to have their story straight now, the lady I spoke to didn't even attempt to fob me off. She stated straight out that i was eligible for a cancellation.0 -

Check out pages 6 & 7 - "How The Rest of Pay Monthly Works", I cannot see footnote 15 referred too, therefore it's not linked to our terms for pay monthly. I note page 12, "Pay As You Go Flat 12", does show footnote 15.
If you check the Sept 08 Price Guide, pages 6&7 do now have footnote 15 attached to voice & fax, video and video mail.
Am I missing something?
If this is correct then that footnote surely does not apply, as footnotes are linked - not to be read out of context on their own.

OK, I've been digging in the loft and have found 'The small print' dated Oct 06 from my Jan 07 contract and dated May 07 from my wife's Aug 07 contract.
What pages are you after?
They're 48 and 40 pages long respectively so I don't fancy scanning all the pages.0 -
Hello everyone,
Thanks everyone I managed to cancel my contract with 3 today without cancellation charges , my contract was due end of August 2009 (18 months contract talk n txt 900).
The way I have done it, is to call 3 customer service and go through the options until I got to the cancellations department, a nice lady answered me and before she says anything I told her my name and give her this little statement ' before we go ahead with security questions I would like to advise you that this call is recorded for future reference purposes.
she went ahead with the security questions and asked the reason for the cancellations, I told her the one minute issue. and she didnt say anything I was put through another department to process my request and I was talking to this nice chab who again I told him that this call is recorded, I had to explain to him again what happened and he tried to upgrade me to a better package which I politly declined, he tried again and mentioned that all phone operators introduced the first minute and 3g was the last one to introduce it. I told him thank you for the information, can you process my request please.
he went on again about the upgrade thing and at this time I inturpetted him and told him that for the past 4 minutes I requested you to cancel my contract and issue me with PAC code and trust me I have the hole day to listen to you, so its up to you either do what I ahve requested or carry on talking knownig it will land on deaf ear.
at this stage he gave up and processed my request. finally I asked him if i need to send cancellation letter and he said phone is enough.

I have received a printed version from 3 for Nov 07,but the only page that refers to the date is the front one,the rest of the "proof" they sent me was photocopied and could have been from any month.
The ref to footnotes on page 34 is on the copy they sent me,which contradicts your version,interesting?!Have I been given a specially doctored version to suit their arguement?Surely there isn't more than one document in the same month.
Also it doesn't even mention my priceplan(t&t600) in the Nov 07 version,has my contract been updated if its not listed?
Otelo are on board now,3 haven't responded to last email or phone call after deadlock letter,fingers crossed,I'll get them!!
There seems to be 3 important documents that are being referred to:The Real Deal,The Small Print and the Price Plan,they all say different things,which one can they dictate is the T&C's?0 -
