I have the T&C's I downloaded in June 2008 (PDF file), dated Nov 2007 - so the new July 2008 ones must be pretty much the next update from this.
As someone else in this thread was told the T&C's tell you in 2.1 that the Price Plan document (I don't have) is also part of your contract, and that said about the per minute billing.
Note it doesn't actually say the price plan document, now my price plan remained the same so it's not unreasonable to think the conditions were the same, I was never told any different.

Just noticed what it says in the "key points" page 23.
"Additional terms can be seen in the Price Guide..."
But I don't think it actually says that anywhere in the Terms, see my 2.1 quote.
Note that "key points" top paragraph says you should really read the full terms, well I did (not the key points) and this section quoted above from the key points is not actually in the terms.
Plus they don't include the price plan document with your phone, so how are you supposed to get it - I didn't realise you had to have an internet connected computer, and search 3's site to ensure you have read all their terms! And be psychic to boot!
Also surely if this information was in fact added to the Price Plan document then surely we should have been told in accordance with T&C 4.1 which states they have to tell us one month in advance before any change to our detriment - it doesn't say a month before the change comes into force, it just says a month before the change to your agreement - which they are saying this document is.0 -

See this is where I think you'd have a good case to argue - it's like a council placing a parking restriction sign 50ft up in the air. They could argue that they've complied with the law in putting the sign up and that it's your responsibility to read it, but they won't actually tell you it's there so you have to guess what's on it.
(at least that analogy sounded good in my head)
I've been with three overall for 2 years and not once have i ever had any letter telling me of any change in my terms and conditions, so I would have thought that if this alleged "end of october" deadline was true, then I would have received the letter last year.
anyway, i've emailed them now and i'm also going to send an actual letter tomorrow.
i've already agreed to switch to T-Mobile since they've offered me 100 minutes a month more than i'm getting on 3, with unlimited texts for a tenner a month cheaper.0 -
