  • 3:39pm : i'm on hold to them now - she's tried to tell me that three have to give 30 days notice for any change in your agreement, so they are not in any kind of breach of the terms and conditions.

    i advised her to look at the website, so i'm on hold .. for how long, who knows ? :D

    while I was talking to her, I kept hearing rounds of applause in the background, so maybe she's nipped off to the leaving do ?

    3:56pm : she is trying to quote section 2 of the terms and conditions to me, saying that 3 are entitled to change the terms of the contract if they give you 30 days notice.

    4:06pm : after arguing with the flunkey for 10 minutes, asked to speak the supervisor, who was actually reasonably non-confrontational. She actually told me that my contract started in Feburary this year, which is a complete lie as I upgraded in December last year, and I even told her the shop I upgraded in.

    She asked me if i wanted to cancel my contract and said she would put me through to the relevant department, which she did (she rang me back, so i'm on hold on their dime :))

    i'm now on hold, and i'm expecting a loooong wait :)

    4:20pm : well not too bad.

    cancellation department are telling me that since i upgraded in december 2007, i am still due to pay a cancellation fee because the "cut-off" point was October 2007.

    i've now asked to speak to HER manager :mad:

    4:22pm : her manager is apparently in a meeting, so she said that he will ring me back in 2 hours.

    we'll see - if anyone reads this who's cancelled, how do you rate my chances?

    i've threatened them with OFCOM already, so i'm not going to let it go ...



    I had the same fun as you... And the same leaving party.. I was on the phone for over an hour with them telling me that as long as they give 30 days notice in writing they called change whatever they liked.. Very rude chap I was speaking to.. I asked him to spell his name out to me and told him that I was contacting OFTELO and contacting his UK office...

    Within 5 minutes I got a phone call from the not so nice man who was nice this time and told me that I was well within my rights to cancel the contract and put me through to escalations... That's when the fun started..

    They offered me every deal on the website and the 750/unlimited txts for £25 but nothing at all for an incentive to stay.. I must of asked him for my pac about 20 times and told him several times we are not going anywhere.. but he kept trying.. He did offer me a SE C902 300 minutes 1000 txts for £24 on a 12 month contract but wouldn't budge on that.. Far better deals around.

    I have received my txt with the pac.. Will three try and offer me anything else before I use the pac or is that it.. I would stay with them if they offered a good deal to stay.. My contract ended in October anyway so I've only ended the contract one month earlier..

    yeah i got this too, just watch out though cos the letter I got was dated 5th August and you have 1 month of this date to cancel. Wonder if they are winging it out saying they will get back within 10 days:rolleyes:

    I have just recieved the notification letter today 21st August and it is dated 5th August. I know I live in rural Devon but really.....!!!!!
    The handset is damaged and we were going to have it repaired as there is 1 year of the contract left, however with only 75 minutes anyway, it would be inadequate with the new changes.
    We will try for the cancellation, with a phone call plus a cancellation letter by recorded delivery.
    Thank you to all the advice on here, or I would have had no idea what was going on. Unfortunately we have another newer 3 contract too.......no letter yet......wonder how long it will take to get here!

  • I've just had a phone call after sending an email on tuesday so i can't call the executive office for thier customer service

    She said that because i re-newed my contract in the middle of November, i can't get a FREE cancelation which to be honest as really p*ssed me of as i wasn't at all aware of this change being implemented.

    It seems now though that i can't get out of my contact.

    Is there anything i can do to possibly get out of it?

    This is what they're trying with me - they've said that since I upgraded in December that I can't do it without a fee.

    What they neglect to tell you is that this is NOT in the terms and conditions anywhere.

    Either in section 2, section 4 or section 10.

    There is a post from someone on digital spy who took out his contract in September 07 and managed to cancel it so you really have to go after them - you'll probably get better success by writing to them (it says in the T's & C's that you do have to give them 30 days written notice) but it's also worth trying it on the phone - especially if you're in the mood for a fight :)

    My cancellation is already in place 28 days from now, Phoned up to see if they would make me an offer to stay, told him my choice is leaving for an iphone or a nokia n95 8gb, only got offered the same deals that are on the web. Told them ill be leaving for an iphone then, he tried to tell me they dont sell iphones due to them having no picture messages and a 3 hour battery life.

    My next course of action i think is to contact ofcom and all the other authority bodies that have been mentioned in this thread and tell them exactly what i received along wtih the letter etc etc and see if they can help me.

    To be honest i'm happy with the contact that i'm on and the service of the phone (my contract being 300mins, 1500 texts, 50 video minutes, 50 picture messages, £5 downloads a month and the msn/skype etc etc per month for £25). I'm just not very happy with this letter that i received last thursday saying that i'm now going to be charged a minute for a 1-59 second call - its outrageous!

    Letter to ofcom here it comes.....
  • I've just tried to fill in a complaint form on the otelo website but its keeps saying that i've got to give them 12 weeks to process the complaint before i can do anything with Otelo.

    Any got the same problem.

    I'm going to have to ring Ofcom tomorrow and see where i stand.

    The letter you recieved is telling you there will be a change in your t&c's so the ones you recieved in the box could not have mentioned this as they would not have sent you the letter. I would email,fax or send a copy of the letter to their head office as you should get to cancel.

    P.S. On other sites there was a mention of this change for some customers back in Dec 07.
