    Well 3 are being efficient at the moment - they cant read - but they are efficient. I got a phone call within an hour of sending the email. I have asked them again to correspond via email and she has promised to confirm everything in writing via email.

    Apparently I will be charged the per minute thing from 23rd September, but she couldn't confirm when I would receive the official letter about it as she doesnt know when my 'batch' will be sent out.

    I said that I wanted to cancel without a cancellation charge as it was a detrimental change to my terms and conditions and she said there was no chance that I could do that, she would be more than happy to take my cancellation but i would have to pay up!

    Heres where the fun begins I suppose!

    Have just been on the phone to the exec office in Glasgow,sent them an email on Tuesday,got the standard reply yesterday about looking into it (trying to find a way out of it more like)and contacting me within 10 days.
    After getting nowhere with cs yesterday and being told I would have a call back by a manager,which still hasn't happened!I thought I'd use the exec office number to speak to someone that might actually listen to what I was saying.
    The guy told me that they wouldn't cancel my contract because of clause 10.1(d) as I upgraded after Oct 07 and the price plan stated the changes on their website,so by renewing my contract he said it was up to me to check the website.No-one informed me or sent a letter to point this out.He directed me to the footnote section on the website,which as you know is dated Aug 08,I asked for a copy from the time of my renewal and he said no problem.Do you think they could backdate a document seeing as they are haso many people trying to leave their service?
    I am really mad now as they seem to have built this brick wall and are just saying no!How is it some people have been able to cancel easily,I'm on talk and text and am still being billed per second so thought I had a good chance.Please can anyone help me find a way out of this,thankyou.

    I think it really does relate to that Oct date, I took my contract pre Oct so was able to cancel he said, made no attempt to lie about or anything, he was straight forward and said that all customers who renewed/took out contract pre oct 2007 were entitled to exercise the get out clause. After that they couldnt.
    I have a second contract with three taken in Jan that I have no hope of cancelling, even on the itemised billing route, ofcom say that it needs to be a change detrimental by 10%, which on an £18 pm contract £1 doesnt count.

    Not to be the bearer of bad news but, i got my contract in March and i distinctly remember there being someting included about the minutes being rounded up. I can't rememeber the doc that it was on, but i remember being told some how, as this isn't news to me.
  • well i renewed in december 2007, vtt 500 , they let me cancel, i had the billing per second letter as well.
  • I still wouldn't give up, I cancelled my contract that was renewed in November.

    I think if you were a new customer you probably have no hope but if you were only renewing its got to be worth a fight, unless they can prove that they made you aware they had changed their T&Cs other than just sending a booklet that looks identical to the previous one. When I renew my car insurance if the T&C have changed there is a letter included which says " new T&C are included we have made some changes you need to be aware of, please read the enclosed booklet carefully in order to understand the nw T&C and their consequences/relevance to yourself". Or its printed all over the front new T&C applicable from00/00/2008 changed please read.

    It depends what tariff you have - some tarrifs already went to per minute billing prior to this latest round.

    Well I fired off an email detailing my situation - gave names of CS personnel I spoke to last night, my OFCOM reference number and also a detailed breakdown showing how this was greater than 10% detriment to me. I also refused to accept that I had agreed to any new price plan upon renewal in April. I asked for the contract to cancelled again, and if they wont then to send me a Deadlock Reference Number so that I can complain to OTELO.

    They probably wont cancel, but I will report them to OTELO and see what happens, I refuse to just bend over and let them shaft me like this.

    I have been a customer for 5 years and am still being billed per second on talk&text 600,upgraded in Nov 07,new 12 month contract started in Feb 08,it just seems to be so random who they cancel and who they won't.I think they've brought in the legal boys big time to try and stop people cancelling by making up these "footnotes" from this month.Let's stick together and keep at them,don't take no for an answer!
