    Although I haven't had my letter yet I've decided to email them anyway. My husband had his letter, so I will just pretend I thought it was to me...

    I hate my N95 so am hoping this will work out!

    Thank you for your recent communications, both by letter and e-mail, regarding the cancellation of your 3 account, due to the introduction of First Minute billing.

    In order to address this matter, I have attempted to contact you on 07@@@@@@@@@ but have been unsuccessful.

    The upgrade of your 3 contract occurred after a call on 2th April 2008, where you agreed to upgrade for a further 18 month term on the Direct Talker 1000 Price Plan, with a Nokia N95 8GB handset. The minimum term of your new upgrade contract started on 5th June 2008, at the end of your original agreement.

    At the time of upgrade, you were supplied with a booklet with your new handset entitled "The Small Print". This booklet contains your Terms for 3 Services, which forms your contract with us. One of the key points of the Terms for 3 Services is that additional terms can be located in the 3 Price Guide, which is available at our website, www.three.co.uk. I have attached a copy of the 3 Price Guide for your ease of reference.

    Section 15 of the 'Footnotes' section of the Price Guide, located on Page 35, includes information regarding charges for First Minute billing. As this formed part of the agreement at the time of the upgrade to your 3 contract, I will be unable to cancel the contract without the applicable Early Termination Fee.

    If you have any further concerns regarding this matter, please contact me at the Executive Office on 08707 330295. Our business hours are 9am until 6.30pm, Monday to Friday.

    Thank you for bringing this matter to my attention and I trust that this clarifies our position.

    Surely sending a booklet out is not enough, they should have included information that the t&cs were changing as well.

    There should be a date on the price guide in the bottom left hand corner of the first page, you'll need to zoom in to see it. what month is it? If it's August, ask for a copy of Aprils when you upgraded.

  • :beer: Hurrah! Got my PAC codes for the two contract phones for three. I got given the whole spiel about a better tariff, about waiving the change in billing, etc and at one point the guy asked me if the phones were in good condition cos he would be arranging to get them picked up once the PAC codes were used! But I stuck to my guns and in the end he hung up on me cos I just kept repeating "please send me my PAC code" over what he was saying! I was livid but 3 minutes later I got the text with the PACs on them - YIPPPPEEEEEE

    iPhone here I come! Thank you everyone who has helped me get rid of this sorry bunch of BLEEPS!

    Yes the date is August 08 on the guide. I am just home from work and have looked out my nokia box. I have 3 nokia booklets and a 3 x-series booklet. There is no booklet with the small print as quoted by 3. !!!!!! At the time of upgrade, you were supplied with a booklet with your new handset entitled "The Small Print". One of the key points of the Terms for 3 Services is that additional terms can be located in the 3 Price Guide, which is available at our website}}}. They are lying through the skin off their teeth. I will be phoning tomorrow to get this contract cancelled.

    SUCCESS - i sent a letter got bored with waiting for a response so i rang three up. after a 35 minute phone call and being told what a great contract and loyaty discount i had she gave in and gave me a pac code (which she did text me a minute after the call ended). i taped the whole conversation for a back up. i was kinda hoping that i wud get a nokia n95 8gb out of it rather than cancel but hey i will get a sim only deal from else where now and use quidco to get £90 quid cash back with vodafone and a free bluetooth headset! i was on a direct texter 1400 and renewed in august 2007 for 18 months. she did try and tell me to ring back in october for sum really gud deals!!like i was fooling for that one - outside of the 30days to cancel my contract!!!thanks for the headsup to the original op.

    I'm glad people are getting their contacts cancelled early because of these changes. If anyone has any advice how I can cancel my Mix & match tariff early :) that would be great!!
