    I have managed to source a copy of the T&C's (or the Small Print booklet) that was in force in June 2008 (when I took out my contract).

    Nowhere in there does it state the per minute billing.... well there isn't any mention of any "Footnotes" so that's something new they've written up in the new T&C's.

    I haven't managed to cancel my contract, but have written a letter to them Recorded Delivered, which they received yesterday. Waiting for a response. If that fails, will ask for a letter of deadlock and let Otelo act on my behalf to disconnect this contract and reclaim line rental since the date of my 30days notice.

    Also, I saved 3's T&C's from their website on Tuesday, and had a look at them today, and they've been updated.... August v2 now as August v3. I haven't looked for the change though!

    Fair enough mate.

    You should download the statements online from 3 and send them to the email addresses above and hopefully they see your right and they are wrong. Otherwise its waiting 12 weeks for the regulators

    Have them in hard copy, sorry. It's a pink cover titled "The small print".

    On the back, it states version as "0040390_v2 Nov07"

    I will be using this to dispute this. I don't mind waiting 12weeks or if they can provide a letter of deadlock, then I'll get onto it asap with Otelo.

    I haven't been able to get the bulk of the T's & C's up though, but everything i've read on them so far actually does NOT STATE that calls are charged per second or minute.

    The "three at home" service still states it's per second billing, but nowhere in the T's & C's for pay monthly does it even mention billing.

    No problem, thanks for the reply,just need to hope someone has them on there PC somehow.

    I have just found the only extra info from 3 that came with my upgrade in Nov07,which is just a small orange card and states:
    "Your terms of purchase..........You have complied with any other relevant conditions communicated to you when you purchased your handset and those contained in the Terms for 3 service(latest version of the small print at three.co.uk)).
    If we can prove that they have only just changed the t&c's I think they haven't got a leg to stand on!But because I wasn't sent a copy of the original t&c's it's going to be hard,unless we can access them pre aug.
    But surely as consumers it's not up to us to check without prompting,which is what they're trying to fob me off with,in all other consumer affairs they have to inform you of any changes legally,which in my arguement is what this letter is all about?!

    when i go on here, the last page i can bring up is "24th october 2007". Surely this is more than a co-incidence with the date change being claimed.

    Can anyone get on it in nov 07 and get the t&c?

    3 hours on the phone to 3, including supervisors and managers and all the say is 'we are in line with other networks' - Basically - Tough - they finally hung up on me - I've had no end of problems with 3 on this contract (i've got 2 others which i'm happy with' ) - As far as they are concerned they can change their charges whenever they want - Luckily I recorded every conversation (and advised them of such)

    Got a faulty phone - replaced 4 times since april and now it will cost me more for the same calls - NOT Happy, but where do I go now ?

    I have the T&C's I downloaded in June 2008 (PDF file), dated Nov 2007 - so the new July 2008 ones must be pretty much the next update from this.

    As someone else in this thread was told the T&C's tell you in 2.1 that the Price Plan document (I don't have) is also part of your contract, and that said about the per minute billing.
    T&C's 2.1 November 2007
    Your agreement is made up of the Terms for 3 Services and your Price Plan, along with any other terms laid down in selected Additional 3 Services on the Handset. Additional terms may apply to any promotional or special offers.

    Note it doesn't actually say the price plan document, now my price plan remained the same so it's not unreasonable to think the conditions were the same, I was never told any different.
