I have a few questions im going to put to the executive office when i get my call today, anyone want to play devils advocate and give their responses ??
T&Cs section 4.1b states if you carry on using the service after the variation commences you will be deemed to have accepted the change.

So the t&c states commencement NOT intention to change
Would they have allowed me to cancel my contract in nov 07 when they 'made' this change and why was i not notified of it then ??
Why has the letter been sent out now, according to them we all already knew about it ??
The price plan appears to change every 3-4 months, in june 08 it says it will comence 30th june 08 why if it had already been changed in nov 07 ??
Help would be appreciated on this, perhaps if we all work together we can stop them weasling out of it !!

It is now too late to cancel on the grounds of a change to your tariff that took place last year - by continuing to pay your bills without question you have accepted the change. (They will insist they informed you pre December 2007)0

Hello everyone, my first post!
I have just received a letter from Three informing me that the way I'm going to be charged for calls has changed. My 18 month contract with them ends in January, which puts the beginning of the contract around July/August of 2007.
Am I going to be able to back out of it?0 -
i would say yes, and probably quite easily.
remember you need to state a 'detrimental change' and give the per second billing change as a reason. they wont accept the itemised billing.

Sorry Quentin but I don't agree with this.
If a bank changed the minimum payment charges on a customer's credit card and informed them 10 months later that, as they had continued to pay them without question, they had been deemed to have been accepted do you really think the customers would just say "Oh, ok that's fine then".
If a housing association had decided to increase their tenants service charge to pay for additional services and told them 10 months later that they had done so, and that as nobody had complained, it was considered that everyone had accepted it do you think the tenants would just accept it without question ?
I don't think so.
What three are doing is tantamount to fraud. I can, and would, testify to having received no notification, until this week, of the change to per-minute billing.
They cannot just assume that the change was universally accepted because nobody complained - people writing to request contract cancellations are fully entitled to do so under three's own terms and conditions because they have only now been informed.
If three wanted to prevent this from happening, they should have informed their customers of the change to per-minute billing when it happened - not 10 months later.

Basicly - Yes.
I took mines out the same time as you and had a phonecall yesterday from the executive office accepting my 30 days notice by email.

I don't really want to break away from Three, so do you think I could use this to negotiate another contract? I'm after a one-month rolling contract so that if I want to get out in future I can.0
