the mix and match contracts were not renewals. I have always gone into phones4u 12 months through an 18 months contract and they have paid me to pay off the old contract and then I have started a brand new one for myself and partner.0

As per the new call charging pattern if you speak for less than a minute your call will be rounded up to a minute. If it’s more than a minute you’ll be charged per second after the one minute is over. So there's no need to cut your calls short, just take it easy and get your money's worth.
Take it easy?? Cheeky b*stards!!The Price Guide details, in the footnotes section (under paragraph 15 of page 35 of the Price Guide) that the Price Plan you are on is subject to first minute billing.
Now this is where I think they're getting everyone, that link downloads August's price plan. Ask for a copy of last November's, unless you have the original price plan from when you took the contract out. They used to have obsolete price plans available to view, but they've mysteriously disappeared. If yo look carefully at that price plan, it's labelled '0819401 Aug08 V2' Ask for a copy of the pric plan relevant to the month that you took the contract out.
Have a look at your old bills, have they charged you for a minute when you've made a call under that time? They're trying it on big time with this 'You've already agreed to it' nonsense, they've already referred to it in their email as 'The new call charging pattern', they've definitely only just changed it.0 -
Can they prove you agreed new terms? Did they tell you at renewal that the T&cs were changing? Its reasonable to expect T&Cs to stay the saty at renewal unless changes are pointed out to you, even if they had said the T&Cs have changed slightly take a look, and you had ignored them then they could say you had agreed but otherwise I dont seehow they can say simply renewing is enough to trigger acceptance. I would take it further and get advice.
Thats what I thought, I must be told that im signing something different as then there could be putting anything into peoples contracts. I really wont let this lie as it will almost double my bill unless I am really carefull.0 -
I always keep all of my paperwork from 3 and phones4u, but I only have the following when I took the contract out in Feb this year-
the phones4u leaflet 'thank you for shopping at phones4u'
the 3 piece of paper with 'oh look. you found us' on it. thanks for choosing 3 and saying the £30 credit for friend referral.
the 3 piece of paper with 'welcome to 3 and thanks for joining'
the confirmation of the dd sign up
the 3 registration form with no real detail on the back cover. reads terms for 3 services - some key points
insurance paperwork
a sheet titled 'are u happy?' funny now hey!!
and our cashback forms
should I have been given all their terms and conditions because I never recieved them?0 -
Saying that, I've still sent them a letter, e-mailed them and sent an email to executive office.

I am going to wait through until I get my last lot of cashback through from phones4u until I try to cancel. I send the cashback form off a week ago and my letter ' although for my other contracts ' is dated the 6th of August.
If I don't wait until I get the cashback then it could mean I loose out on the £210 cashback for 2 phones and I don't want that.0 -
I have been reading the thread since day one, contemplating whether to try cancelling or not.
I took out a mix and match 300 tariff in October (before 25/10/07) and was billed per second on voice minutes, it is not until I was reading this thread and looked through my statements did I notice that they changed this to a 1 minute minimum from December 07.
I haven't received a letter, but as they had already changed it in December and I never queried it then I have presumed there isn't much point in trying to cancel with the change in the t's and c's.
What does anyone / everyone think ???

I didn't mention anything about the rounding up to a minute.
I used an email that someone posted here. I just took out the bits about the minute billing and changed a few words lol.0
