    i took the 1100 mix and match 18 month contract out in Feb this year. What do you think my chances of cancelling are with a phone call to cs where I am willing to stay on the phone all day if needs be?

    I got an e-mail from executive office saying they'll get back to me within 10 working days!

    The response I got, I renewed my contract in November over the phone but looks like im now trapped. I never got told of any possible change when I renewed.
    Hello Mr Redmayne

    I’m sorry to know that you’re not happy with our new call charges and have decided to leave us.

    We are the last UK operators to introduce a minimum call charge. We have made the changes in line with the way majority of operators bill.

    As per the new call charging pattern if you speak for less than a minute your call will be rounded up to a minute. If it’s more than a minute you’ll be charged per second after the one minute is over. So there's no need to cut your calls short, just take it easy and get your money's worth.

    However if you still wish to close your account, you’ll have to pay a fee. This is currently £ 288.97. Please bear in mind this doesn’t include any outstanding bills, which you can pay the way you normally do.

    The 30 days notice applies to any new changes we make to the Terms & Conditions. Since you signed up after the 25/10/07, you agreed to the new Terms & Conditions. Which is before your contract start date and this is the reason the terms and conditions don’t apply for this particular change.

    The price plan you are on (which is detailed in our Price Guide) forms part of your contract with 3 -This is detailed in section 2.1 of the Terms for 3 Services (see “The Rules” section of the attached link). The Price Guide details, in the footnotes section (under paragraph 15 of page 35 of the Price Guide) that the Price Plan you are on is subject to first minute billing.

    I’d recommend you to wait for a month and see how you can manage your bills. You can use My3 to get an up to date snapshot of your spending helping you to stay in control.

    I'd ask to see the ts + cs she says you agreed which are different to the ts + cs currently in force (ie the ones with 10.1 d in them)

    I'm on the same tariff & took it out in May this year.

    The only thing that we're affected by is the itemised billing charge but as far as I know no-one has been able to cancel solely because of this charge.

    Saying that, I've still sent them a letter, e-mailed them and sent an email to executive office.

    I'll just have to cross my fingers and wait and see!

    I think calling them would be a waste of time to be honest.

    i have 4 three contracts up and running: -
    • 2 are on 1100 mix and match and were taken out in Feb this year. I have not recieved a letter at all for either of these phones.
    • 2 were taken out in September last year, but I don't want to cancel these as the offer when I took them out was 12 months free line rental on a 12 months contract. :rotfl: :rotfl: I have recived a letter for one of these accounts stating about the itemised charges and the rounding up to 1 minute.
    if there's a way to cancel the 2 on mix and match then I want to as my partner 'fell in love with the phone' LG viewty:mad: :mad: in the shop and hence after the cashback it is £20 a month :eek: :eek: for the whole of the 18 month contract. All cos he fell in love with the phone he agreed at £20 a month. I was thinking more like £3 a month which was an offer on the net. So if there's anyway of getting out of the contract and he can still keep his phone then I'll try it. I don't care about the phone they offer only the contract.

    I have already changed the billing type for all 4 contracts so I don't get charged for these but the 1 minute rounding up is pi**in* me off.

    Can they prove you agreed new terms? Did they tell you at renewal that the T&cs were changing? Its reasonable to expect T&Cs to stay the saty at renewal unless changes are pointed out to you, even if they had said the T&Cs have changed slightly take a look, and you had ignored them then they could say you had agreed but otherwise I dont seehow they can say simply renewing is enough to trigger acceptance. I would take it further and get advice.
