Hi everyone, just had the letter through a few days ago informing me of the changes. Haven't read all the thread, but is the concensus now that it is possible to get out of the contract early?

Yes you can. You can either do battle with customer services over the phone or write to them and hopefully they'll get in contact with you (as they have just done with me). In my experience they don't make it easy though!

    Well Peeps........

Update on My 3 saga...Queried changes in T&C .. call charges, itemised billing, DD already in place. Spun the usual scriped reply for about 5 minutes. Held firm stating that 3 had breached the terms of my current contract...

Eventually passed to Cancellations Dept who asked if there was anything they could do to keep my Custom??? Nope! Cancellation to contract accepted via the 333 number. PAC code issued 2 minutes after call to 3... getting better.

Call am today from 3 - Offered £5/mth for life for 250 mins xnetwork and 50 Txts. No surrender!

Call pm today from 3 - Offered £10/mth 12 mth contract 750 mins x/network and 150 Txts & a new Sony Ericsson K5301 mobile? They had just upgraded me with a Nokia 6500 slider 4 x weeks ago!

Hope this helps someone? Think with this offer I will stick with them for another 12mths........?!

Ok, thanks CJE, sorry to be lazy but is there a specific paragraph of the t&cs I need to quote to them, about the change being detrimental?

As I'm feeling especially generous after my success I'll even let you have a copy of my letter:-

"I am in receipt of your letter dated 5 August 2008 and note that as of 23 September you will be changing the way your calls are billed. I am therefore writing to give you thirty days notice to cancel my contract.

I have the right to cancel my contract under clauses 4.1b(ii) and 10.1d of your terms and conditions as these changes are of detriment to me. As a result of this I understand that no additional charges will be made for cancelling the contract.
I also require a PAC code for my above mobile number.

Please can you confirm as soon as possible that the contract will be cancelled after thirty days.

I look forward to hearing from you with a satisfactory response as soon as possible."
  • This is the letter I sent, and I believe others have used.

    Dear Sir/Madam

    Mobile Number: ***** ******

    Account Number: **********

Following the recent changes to your call charges as per your letter dated 5th August 2008, as these changes are of detriment to me I am writing to give you thirty days notice to cancel my contract, as set out in my contract in parts 4, 4.1b(ii) and 10.1(d)

Please can you confirm as soon as possible that the contract will be cancelled after thirty days. I understand from the contract that no additional charges will be made for cancelling the contract.

Thank you for your past service.

    Kind regards,

Can anyone confirm they have successfully ended their contract early whist being on a Mix and Match tariff?

    Cheers

  • HI i have just spent 45mins on the phone to 3 about the changes to my contract and was told that i would have to pay for the paper bill or go e-bill, i have been a 3 customer for 8yrs and this will be my last year with them. My contract finishes in december if i want to cancell early i was told that i would have to pay them £104, they said that because they have given me the 28 days notice i can not do anything about the T&C changes as its in the small print of my contract, also they say they are the only company that does not charge for paper billing, i am so angry with the way the customer services have handled this that i will be sending a letter to the head office and telling them what i think of them.
I am going to reduce my contract to as little as possible then will cancel in december.

You seem to be giving in too easy! (You always like that???)

When they say you can't do anything "as its in the small print", ask them to read this small print out to you!
