    I received the letter but because I'm on a Mix & Match price plan which was taken out a few months ago, only the itemised billing and DD charges apply to me.

    I know that I'd have a right to cancel if it the rounding up to a minute applied to me...but it doesn't.

    So basically I'm stuffed I take it? Lol

    After reading through all the terms and conditions for the different packages last night it looked like certain mix and match plans Voicemail are not included in their minutes but are free. This differs from my plan which includes the voicemail in my minutes. Am I reading this correctly?

    I'm on Mix & Match 1100 and calls to Voicemail are free.

    I thought it was free on all M&M plans. Well that's what it says on the price guide :confused:

    That's what I thought. Unfortunately I'm not on a mix and match otherwise it would not bother me too much.

    Just posted my letter to them, I counted up 75 calls under 59 seconds and a lot under 30.
  • I've got the guy on customer service to read 10.1d word for word, and yet he claims that it is not valid in these circumstances, and also:

    the changes in rounding up to 1min for calls up to 59sec is required by law (!!!!!!!!)

    and that all UK mobile companies have implemented this. when i pointed out he was lying as orange do not he back tracked and said "most mobile companies"

    !!!!!! the lot of them. on hold for 30min now...

    If required by law, then they should have stated this new legislation in the letter that we've all received. They have adhered to their part in the T&C's - 4.1(b(ii));

    (b) if you are a Pay Monthly Customer, we will let you know at least one month in advance if we decide to:
    (ii)make any variations to your agreement which are likely to be of detriment to you;


    I have written my letter stating the following, and asking for an explanation as to whether they have the same version of the contract as me;
    10.1 You may end this agreement in the following ways:
    Within one month of a detrimental variation to your agreement. You can end the agreement within one month of us telling you about a variation to your agreement (which includes your Price Plan) which is likely to be of detriment to you. You must give written notice to 3 Customer Services within that month and your agreement will finish at the end of that month once we receive your notice. (A Cancellation Fee will not be charged.)
  • 4. Variations to your agreement or prices
    Pay Monthly Customers
    4.1 We may vary any of the terms of your agreement, including our Price Plans, on the following basis:
    1. any updated Price Plans and new terms will be available on our website and on request to 3 Customer Services;
    2. if you are a Pay Monthly Customer, we will let you know at least one month in advance if we decide to:
      1. discontinue your Price Plan; or
      2. make any variations to your agreement which are likely to be of detriment to you; or
      3. increase the fixed periodic charges for your Price Plan (if applicable) by an amount which is more than the percentage increase in the Retail Prices Index Figure (or any future equivalent) in any twelve month period.
    You can end the agreement for such variations as explained in Section 10. Subject to the above, you will not be able to end the agreement if such variation or increase:
    1. is due to changes to the law, government regulation or licence which affect us; or

    Also, one thing that 3 customer services has said was that the change in rounding up call charges to the nearest minute was required by UK law. I find it hard to believe that regulators like OFCOM would allow such a change that is can be nothing but deterimental to consumers. If this is a barefaced lie that 3 are trying use to put people off then it is an absolute disgrace.

    The "you renewed your contract after October 2007 so you accepted the rises" line was also used. Apart from the fact I was not told of this, clauses 4.2 and 10.1d still applies.

    Any thoughts?
