    I do admit to my "SIN" but there should be some way to make them agreeable as it is a very tuff attitude of OSPS and some other gentleman might experienced something like me and resolved it. Is there anyway someone may guide me as to where will I stand in the court. Please help


    I think you're stuffed really. In the small print, it says to check all equipment and documents upon receipt. The sales staff will also have told you to do this (I imagine the call was recorded) and to inform them immediately if anything is missing. From my research this seems to be a common reason they use to avioid payment. It's not particularly pleasant, but they are covered by their T&C.

    masud: Sorry to say but OSPS aer very harsh if you don't follow their T & C's to the letter (in fact, they can be problematic even if you do).

    I think the only thing you can do now is some damage limitation. I recommend you try to find some way to claim your final cashback from them, otherwise phone up your network and lower your tariff.

    The Money Claim procedure is very easy [use ie not firefox] and I'll repeat Boatman's link from earlier in this thread in case anyone needs it.

    Received a cheque today for the cashback and the £30 for the Moneyclaim fee. Countless phone calls, letters and emails got me nowhere. The threat of County Court got me paid up in 9 days.
    This was my first attempt at taking any sort of court action, but having seen how simple and effective it has been I won't hesitate to use it again. It also makes me feel a bit more confident to take out other cashback offers, although I'll see how my second cashback claim [due 29/12/05] goes down with OSPS before I use them again.

    WEll done mate. I also got two cheques today for £178 ech. This is despite them writing to me two weeks ago sying my form was submitted late and that they would not pay me. The letter threatening court action obviously owrked - especially since I cc'd their lawyer dealing with my first set of cheques - I sued them for those and they settled out of court. I will take cash back offers agin but never from these scum!
  • As I've said before, if companies wanted to give you cashback, they could do it automatically without any input from the purchaser. They make it as hard as possible for a reason, and thats to hit there targets for not paying these.
    If you've got it sorted, well done, if not do as above and threaten to sue. Chances are it'll work.

    I got this email from osps manager on 2nd november after a lot of phone calls etc never got me nowhere-

    Thank you for your e-mail. We are currently running the auto cashback for September, so would expect your cheque to be sent in the next few days.

    The recommend a friend vouchers are aslo run once a month, after a verification process, which I also understand is underway.

    My apologies that this has not come sooner.

    It is now 10 dec and surprise surprise no cashback,ive been on contract since 10 sept 05,and this is my auto cashback payable after 1 month,all i get is excuse after excuse,i have just sent 4 identical emails to nick edwards stating if i dont receive soon i will seek legal advice.
    Does anyone have any further advice to help me receive my cashback from this ridiclious firm.also they owe me £10 referall vouchers as they tried sending me £10 less than as promised.

    I am thinking seriously to give them a notice and start the legal proceedings. Whatever financial injury they wanted to inflict they have already and a further £30.00 in the court wont kill me

    after hearing all these success stories with getting them to payout I won't hesitate to threaten and go through with the court proceedings if they mess me around again.

    Just to report that I received my 1st round of cashbacks on 2 contracts with no chasing and only a couple of weeks after the due date (about 5 weeks after posting off to them).

    These were not 100% straightforward as I had changed the numbers on both contracts, but I explained this clearly in writing when I submitted the claim and it all seems to have gone through smoothly.

    Its not all bad and now no worse than the standard CPW service.
