Value of Estate for Inheritance Tax AND Probate - What's the difference?
HMCTS require more information, following my online application for probate back in September 2023. The probate is for my late mother and I believe her estate would be classed as an Excepted Estate. My father pre-deceased her twenty years ago and everything went to my mother. The gross value of the estate (property and…

Tax due on interest accrued on a deceased person's savings account
Following my Mum passing away and the completion of the
probate process, I received a letter from my Mum’s bank last April, saying that
they were going to pay me the interest which had accrued on Mum’s savings after
her passing, and that I was responsible for declaring that to HMRC for tax
purposes. I wrote to HMRC with…

Tracing missing relative
A friend in Australia has asked if I can help regarding an elderly aunt who he hasn't received a Christmas card from. All he has is her name and an address in Welwyn and no other contact details. On checking Rightmove I can see that her house was sold last November so it's possible she has gone into care or may have died.…

Will has been destroyed.
Hi.I don't have the full details of the situation yet, but I understand that if an author tears up their latest Will, they then become intestate. Ie, it doesn't revert back to the previous Will? Is that correct? What if there is some evidence - diary entries etc - that the author's intention was to simply remove the latest…

Cost of amending a Will
My aunty and uncle have mirror Wills set up about 15 years ago. There are no complications other than a trust that has been set up for their disabled son. Winning Lottery and Dividing between Sons and Daughters
I just thought about Martin saying you could win the lottery and drop dead from the excitement. What happens if you win 100 millions on the lottery and divide it between your spouse, sons and daughters then drop dead after they have received their share. . Do they each have to pay inheritance tax on their share?

Giving to Charities in a Will
The recent Money Tips (11th March 2025) says in the section on Free Will drafting " in the hope you'll leave them a bequest (money in your will) of typically £300 to £1,000, or a percentage of your estate." Warning (not just for free wills), if you leave a bequest to as a percentage of the estate, the charity's accountants…

LPA query after Martin's show - 5 people to sign?
Hello Can anyone help or shed light on Martin's statement that a "minimum of 5 people need to sign an LPA"? This was clearly stated on his presentation last night (just watching now). It's put us into a bit of a panic as we're in the process of getting an LPA registered and this was NOT the case. We did it all online and…

Discretionary Trusts - tax implications for beneficiaries.
My father set up 4 Discretionary Trusts for his (now adult) grandchildren 25 years ago. His total estate will fall below the IHT allowance. On his death, the grandchildren will receive approximately £14k each. Will they be personally liable to pay tax on this inheritance? Many thanks in anticipation.

Is it normal to have a 'thirty days' clause in a will?
Without going into too much detail, married couple and one of them has died. There is a clause in the will which states: 'If my [Spouse] survives me by thirty days I give the whole of my estate to [them]". I'm curious about the 30 days? Is that standard? Why not just give it all straight away?
