Part of a house in a trust
Hi all, I feel like a complete novice despite being middle-aged. To keep it brief: my mother passed away and left me half of her house in her will, specifying that it should be placed in a trust. Since then, her husband has become unwell and now resides in a care home. To cover the care home costs, I need to sell the…

No will, inheritance query
Trying to get clarity for a friend whos elderly mum has died. Husband died years ago. Estate below Inheritance tax threshold. 2 living children, 1 child who died a couple of years ago. Government website says estate divided equally between living children under intestacy rules. It then appears to contradict this if the…

My partner died and my son needs a trust account as he is the sole ben
Hi, My partner died suddenly without a will so I have to follow the rules of intestacy for probate. My 6 year old son will be the sole beneficiary of my partners savings (luckily we owned our house as joint tenants) but as he is young I have been advised I need to find an account that he can't touch until he is 18 and has…

When to post notice in Gazette?
I've not managed to find anything definitive about when to place notice in Gazette - some places say after grant of probate. Is there any reason I cant/shouldnt do it before probate - seems like the sooner done the better? Thanks

Sell shares quickly?
Just received probate today and getting up to speed with how to distribute an estate. Believe the estate will have its own capital gains allowance of £3000 for this year to 5th April (and for the next 2 yrs). The estate contains some shares with a gain of about £1000 that I think it would be advisable to get sold before…

Gift with reservation
My MIL gifted her house to get 2 children in 2012 and died in 2024. Probate has gone through but the house wasn’t included. We have since been advised that the gift has failed as she didn’t pay any market value rent, should this have gone through probate as there could now potentially be a big CGT bill to pay. The probate…

Think I got probate values wrong - implications?!
Three years ago I acted as executor for my father's Will. I calculated his IHT figures and his estate was well below IHT limits so didn't complete an IHT return but I did need to get probate to obtain money from one of the banks that was in his name. My parents were tenants in common 50:50. Mum is still alive and all banks…

Is This Transfer Legal? Surely not...
So, my father passed away in December. Without going into all the gory details, a family member who must have had access to his internet banking transferred £5,000 to her own personal account the day after he died. Maybe unfortunately, this individual had also managed to get herself in his will as one of the three listed…

Inheritance Tax -Joint Bank Account
Hi everyone, Please be gentle, as recently lost my dad and I'm still reeling from it. My dad passed away 5 weeks ago, he hadn't set anything up in terms of wills or anything, but I had a joint bank account with him which was all his money. He often liked me to do online shopping for him so that's why we had it, and I never…

IHT 403
I’m trying to fill in IHT 403 - specifically the annual income/expenditure at the end to show there is sufficient money for regular gifts out of income. I can get most of the information from bank statements. Under income there is a box for ‘income tax to be deducted’ - does this mean I have to find the gross pension…

Tenants in common rights to keep family home
My partner of 5 years recently died in an accident. We bought a house together a year ago and foolishly hadn’t done wills. Our home was purchased with a joint mortgage, tenants in common and the equity in it is 60% mine and 40% his. My partner has left somewhere in the region of around 500-600k in his estate with combined…

Incorrect amount on Probate Certificate
I’m hoping someone can help. I lost my mother in December and I applied for probate online to deal with her 50% of the house that was put in trust. when I inputted the amounts of my mums estate it specifically asked not to include joint assets so me thinking the house was a joint asset I didn’t include it. Little did I…

Transferring ownership of inherited property - Advice please!
Hello everyone, This is the first time I have posted on this forum, but I would really appreciate any advice. I have just been granted Probate as the executor and sole beneficiary of my late mothers house. My father is still residing in the property and will be until the end of his days. My questions are: How do I transfer…

Inheritance tax and Trust question.
86-year-old single (divorced) parent in good health, no current signs of needing any sort of care. For the avoidance of doubt this is absolutely not a question about avoiding paying care fees in the future. Complicated by the fact that I don’t know what parents assets are. House worth maybe 300 to 350 K. Pension and…

Is formal house valuation required for probate?
I am the executor of my father-in-laws will. It is a fairly straight-forward estate with only being some cash in the bank and a terraced property. The value of the estate is well below the IHT value for tax and hence I am looking to apply for the grant of probate myself rather than go through solicitors. As he was widowed…
