DIY Will - Omissions?
I don't have a Will. My situation is relatively straightforward, so I've attempted to do a DIY Will based of several templates I've seen. In short I want to: - Give everything to my wife (house, cash, investments, the lot) - If she's not around, give everything to my two kids, split evenly - Define who should be guardians…

getting a caveat of probate removed
The estranged son of my uncle has lodged a caveat of probate against his father's will. They did not speak for 5 years before his death. He has been sent the will and letter of wishes, which clearly show his father's intentions. He is still a named beneficiary of a discretionary trust that is to be set up after probate to…

Is there an IHT downside to selling a home if parent has moved into a care home?
My dad has just moved into a care home. His wife has already died and he inherited her share of their house. He has a house worth £600k and some savings of £150k. He doesn’t need to sell his home immediately to pay the care home fees as this can come out of his pensions but may as well as he won’t be going back to his home…

Who pays for repairs?
My father in law died in January. My husband worked with his father and his father owned the property where they worked. The property has been left to my husband but needs repairs to the roof. It was planned for these repairs to be done shortly. Who should pay for these? Surely the property is still owned by father in law…

Transfer of property after death
I have inherited a property and just want to get the name changed on the deeds etc. All probate and inheritance tax is finalised (by me) I would have liked to have had a go at completing the AS1 and AP1 forms myself to save costs but it looks like I would still have to go to a solicitor for the ID verification checks. Is…

Inheritance: Tenancy in Common and having to live with somebody you wouldn’t want to!
I have been friends with an elderly couple for about several years. Both had been married before with children from their previous
partnerships. They owned their home as Tenants in Common with the husband’s
disabled daughter living with them. A year ago, the husband died. His widow was not an executor
of his estate and has…

Understanding net probate value
Having a go at diy probate. I have used the online calculator. Probate net value is £175,000.What does this means pl? House £350,000. I understand the NRB is £325,000. Also if he has given £25,000 gifts for past 7 yrs, does that mean he has got £325,000 unused NRB to pass to the surviving spouse. Thanks

Executor - how to 'oblige' parties to hand over info and items?
Hi. Not me, but a friend. She's the executor of a late-friend's estate. She's getting all the info together to apply for probate, but it's become clear that there are some folk who have had dealings with the deceased - loans, and suchlike - and others who have possessions that they took from the deceased's house that they…

Personal indemnity insurance after death
My father, who was 88, recently passed away and i am the sole executor of the estate. He was a self-employed accountant who had been slowly winding down his clients over the last few years and stopped practising in 2023 (although i think he still did a couple of very small jobs in 2024). I believe we still need to have PI…

Family executors unwilling to start probate
My step-dad passed away the back end of 2023 and in his will he named two of my step-siblings as executors in his estate. Being mislead by stonemason?
Hi All, I would like a view on this matter. I contacted the stonemasons that crafted a cremation stone for my late father back in 2000s. I asked them for an estimate for retouching a few letters and adding a new inscription for my mother. The estimate that came back was for redoing all the last inscription (not asked for)…
