Advice please! Administrator delaying distribution of estate.

Hi I'm looking for advice please. My father died without a will over a year ago. My brother applied for letters of administration in his own name. I am a 50% beneficiary of my father's estate. My brother moved his son into my father's house the day after my father's funeral and despite my objections he has been living there this entire time without paying any rent to the estate. My brother told me his son was going to buy the property when he moved in. To date this has not happened. I instructed a solicitor and was sent an estate summary from my brother's solicitor. There was no mention of his son's occupation and I disputed other things stated in the summary. Further letters from my solicitor have not been responded to. If I take him to court it will be expensive. Can anyone suggest an alternatives and do I have the right to request back dated rent be paid to the estate. Thank you.

    I'd check to see that the ownership of the house hasn't been changed.

    You can inform him that you will be looking further legal advice and seeking compensation both for the lack of income to the estate, I presume nephew paying council tax and utilities, and for te delay in winding up of your fathers financial affairs.

    It sounds as though your brother believes by moving his son in as a fait accompli is frustrating the sale. Can your nephew even get a mortgage to buy out your share of house even if your brother gifts his portion as deposit?
