Inheritance Tax -Joint Bank Account
Hi everyone, Please be gentle, as recently lost my dad and I'm still reeling from it. My dad passed away 5 weeks ago, he hadn't set anything up in terms of wills or anything, but I had a joint bank account with him which was all his money. He often liked me to do online shopping for him so that's why we had it, and I never…

IHT 403
I’m trying to fill in IHT 403 - specifically the annual income/expenditure at the end to show there is sufficient money for regular gifts out of income. I can get most of the information from bank statements. Under income there is a box for ‘income tax to be deducted’ - does this mean I have to find the gross pension…

Tenants in common rights to keep family home
My partner of 5 years recently died in an accident. We bought a house together a year ago and foolishly hadn’t done wills. Our home was purchased with a joint mortgage, tenants in common and the equity in it is 60% mine and 40% his. My partner has left somewhere in the region of around 500-600k in his estate with combined…

I lost my mother in December and I applied for probate online to deal with her 50% of the house that was put in trust. when I inputted the amounts of my mums estate it specifically asked not to include joint assets so me thinking the house was a joint asset I didn’t include it. Little did I…

Transferring ownership of inherited property - Advice please!
Hello everyone, This is the first time I have posted on this forum, but I would really appreciate any advice. I have just been granted Probate as the executor and sole beneficiary of my late mothers house. My father is still residing in the property and will be until the end of his days. My questions are: How do I transfer…

Inheritance tax and Trust question.
86-year-old single (divorced) parent in good health, no current signs of needing any sort of care. For the avoidance of doubt this is absolutely not a question about avoiding paying care fees in the future. Complicated by the fact that I don’t know what parents assets are. House worth maybe 300 to 350 K. Pension and…

Is formal house valuation required for probate?
I am the executor of my father-in-laws will. It is a fairly straight-forward estate with only being some cash in the bank and a terraced property. The value of the estate is well below the IHT value for tax and hence I am looking to apply for the grant of probate myself rather than go through solicitors. As he was widowed…

NS&I trust account
As Executor to my elderly father, I am trying to plan for the moment IHT has to be paid but probate has not been granted. I had thought there was some way of setting up a “trust” account with NSI which doesn’t count towards estate valuation for IHT and also can be used for the IHT payment. But I cannot now find this. Or is…

How to claim unused NRB on second date?
If there was no probate on first death how do you claim that person unused NRB? When filling the IHT forms, there is a question do you want to claim unused NRB? With no probate and IHT forms completed there are no records of the late person assets? Does this question make sense? It’s doing my head in whether to apply for…

Using estate funds to sell a property - conflicting advice
I took some legal advice from a solicitor and they have stated that under the Administration of Estates Act 1925, the executer can sell a property and use funds of the estate to sell the property - estate agent fees etc. This is contradictory to advice received on this board. I understand that advice on here is not…

What is visible when people request copies of wills/probate from the Probate office
Hello, I’ve just sent off my probate application as executor for my friend. In doing so it mentions that the will will become a public document and retained by the office. What does that mean in terms of the information freely available to people? I’m conscious that my address is on the will and the information I put in…

Value of Estate for Inheritance Tax AND Probate - What's the difference?
HMCTS require more information, following my online application for probate back in September 2023. The probate is for my late mother and I believe her estate would be classed as an Excepted Estate. My father pre-deceased her twenty years ago and everything went to my mother. The gross value of the estate (property and…

Tax due on interest accrued on a deceased person's savings account
Following my Mum passing away and the completion of the
probate process, I received a letter from my Mum’s bank last April, saying that
they were going to pay me the interest which had accrued on Mum’s savings after
her passing, and that I was responsible for declaring that to HMRC for tax
purposes. I wrote to HMRC with…
