I wouldn't wait too long as you've only got another week or so to put up your argument before you are listed as accepting the new situation by default. I'll be calling them T-Mobile to put in my argument this afternoon, shortly afterwards I'll be calling Ofcom.
And yes, I do call a few 08xx numbers but at the current price its not too much of a problem but if they put the price up by this insane amount then its gonna really rip into my budget0 -
I'd also be interested in an example of a letter someone has sent regarding the Ofcom recommendation if anyone has one.0

Yep that is it in a nut shell. about time they reduced roaming charges as they were a rip off. :mad: It shows how much money they were making in the early days though..££££££££££££ loads..it will be interesting to see if the other operators follow suit.0 -
Right, the battle continues... I sent a letter but surprise surprise it never turned up. I have since called them this afternoon and had lengthly conversations, first with a not so nice women in retentions, and then with a nicer women who was a manager of some type.
I ran through my argument that seeing as the cost of 0845 numbers is set down in the Additional Charges booklet as it's an optional/extra service according to them, then by their definition it counts as a Service, and by definition again the "Price Plan Charge" that they cannot change above the RPI includes any Service outside of my allowance which obviously the 0845 numbers are as they are not included. The argument really revolves around definition which is whats causing the trouble more than anything.
Anyway, I decided to let them mull that over for a little bit and instead took the tact of the General Conditions that piggeh mentioned, specifically 9.3 and 12.2 which seemed most relevant to me. That seemed to stump them and it has been referred to the legal team for their advice on the matter.
I've emailed my letter to them again as I got a direct email for the woman so she can read it and forward it also. She is going to call me back tomorrow morning.
I reckon the General Conditions could be the turning point, the woman agreed with me that whilst the call rates to 0845 numbers wasn't a price plan charge it wasn't certainly a part of my contract and indeed has been increased substantially. I am certain that it won't be hard to argue that the increase is of material detriment seeing as it's so high.
On a side note, Ofcom did confirm that the increase in charges that T-Mobile introduced was nothing to do with them whatsoever, despite what T-Mobile may say, lol.0 -
Finally we get the legal position from T-mobile. Note the stalling for time...

Please find attached the application form and Rules for CISAS.
T-Mobile have fully explained its position in respect to calls to 08 numbers. Calls to 08 numbers are regarded as Additional Services and have never been included within your price plan allowance. In accordance with Clause 7.1.2 of your agreement it is provided that we can increase a charge to those additional service upon giving reasonable notice that charge would take effect upon expiry of the notice period. However, as this is not a specific increase to your price plan then you have no contractual right to allow you to cancel your agreement without paying the cancellation charge. We are not in breach of our agreement with you.
We can provide you with a PAC code to enable you to transfer your mobile number to another service provider, however you would be required to pay the cancellation charge as your agreement would be cancelled within the early termination period.
Should you wish to bring an application to CISAS then you are free to do so. However, T-Mobile are not prepared to consent to the matter being brought within the initial 3 month period from the date of complaint. Should you wish to bring an action after that period you do not require our consent to do so.
Should you however bring an application to CISAS in respect to the above matter then we will vigorously defend such application on the above basis and furthermore produce evidence to the effect to show what usage of calls were made to 08 numbers prior to the date of the increase in charges.

I have dropped my tarrif to the combi 15 so where I was paying T-Mobile on average £40.00+ a month I'm now only paying them £17.00, I still have 8 months left on my contract so some self control in not dialing 08 numbers is required on my side but I'm more than satisfied with knowing my action has now cost T-Mobile a loss of £180.00 in revenue :0 only needs others to do the same and alarm bells will start ringing somewhere.
Reading between the lines of the above post.....and furthermore produce evidence to the effect to show what usage of calls were made to 08 numbers prior to the date of the increase in charges.
It looks like T-Mobile are looking at the user's calling 08 numbers prior to the change so if they didn't make many 08 calls then they are on wobbly ground with the argument that the change would hit them in the wallet, I'd like to see T-Mobiles responce to someone who makes a lot of 08 calls.Be ALERT - The world needs more LERTS0 -
The whole "consent" thing sounds a bit dodgy. I'd recommend giving CISAS a ring to see if they will accept that e-mail as a deadlock letter.0
