T-Mobile price increase for 08xx numbers

Really good letter Sparks001. Got a suspicion that T-Mobile may say that you are now bound by version 55 (came with the May bill) as they can vary the terms from time to time. I'm not sure how version 55 compares to version 52 but I find it strange that they only announced the price increases when version 55 came into effect this week.
My understanding is that there was nothing we could challenge in the new terms because there was no financial detriment. Of course, there is now but I can't really comment as I don't know how the two versions compare. Could it be that T-Mobile removed/added terms which would prevent us from ending contract early? Hmmm... not sure.0 -
dvs, I think you may be right, I'm pretty sure that the Terms and Conditions are updated from time to time and unless you reject the changes (if a change is made that allows you to do so) then you are bound by the new terms and conditions v55 which was changed as far as I can tell to move 08xx numbers outside of the price plan.
However, the fact the website clearly states that the changes are changes to the price plan, I can't see they have much to go on really.
That was an excellent letter sparks001, I may send a similar letter although I would need to refer to v55 as I am certain I am bound by those. Although I guess a call to T-Mobile could clear that up quite easily.

A quick update, I have been told that I am bound by v55 of the Terms and Conditions as they were updated in March 2008.
I don't think this is as much as a set back as one would hope, after all the website itself specifies that they are changes to my price plan. Plus if they were not part of the price plan then they would be the same changes regardless of the tariff people were on, however the price of 08xx calls varies according to the tariff you're on suggesting that the pricing they are changing is inextricably linked with my price plan enough to be a detriment, afterall I could change tariff perhaps and get a lower call rate to 08xx numbers, some people are better off than I am.0 -

Having re-read the existing T&C's (v52), there does not seem to be any mention of me having to accept any new T&C's, nor any wording saying that I will automatically be seen to have accepted the new conditions if I don’t specifically reject them within a certain timescale, therefore, I think the original agreement will still be in force until I actually accept any new agreements. - what do you lot think?
The existing T&C's also don't mention about notice T-Mobile are required to give customers when changing the T&C's either! (Only notice about increase in charges and price plan withdrawal) which is probably makes the contract unfair.
They also state "(g) We can change these conditions for any good reason, for instance, if we
want all customers on the same conditions. We can change charges or change
or withdraw your price plan (see 2(c)(iii)). We will write to you (by postal
or electronic means) 30 days before we increase our charges or withdraw your
price plan. If we change conditions we will tell you why."
Assuming I don’t get another text at 0:00 on the 28-June-2008 This has been breached by T-Mobile, as I have been given notice of the change 41 days 13 Hours and 40 minutes before the change, which according to their own terms and conditions, is too early!0 -
My understanding is that there was nothing in the terms v55 which would make changing from v52 to v55 detrimental (that any of us could've foreseen). Obviously, if we knew that they were going to raise charges following the introduction of v55 then we could've opposed the terms. I think T-Mobile may have got away with it.
I don't think whatever they say on their website would be legally binding. They'd probably just say that the words are not part of your contract (i.e. use of the word price plan does not constitute price plan in the terms) or that the website doesn't form part of your contract.
I think that it is interesting that T-Mobile are saying that call charges for 08XX are not part of the price plan yet they have individual pricing for 08XX numbers based on price plans. Now obviously, they are saying that we are being charged the same rate for 08XX numbers as we would for 01, 02 and 07 numbers based on our price plan. Funny that T-Mobile have chosen to follow OFCOM's recommendation in terms of it being the same price as other calls but not allowing it to be inclusive.
I think T-Mobile are wrong here and perhaps with consumer pressure (or complaints to OFCOM) they will back down. Shame Watchdog isn't on. That usually does the trick.0 -
I'm on T-Mobile at the moment and am gutted that they're upping the price of 08 numbers; I make a lot of calls to these numbers for work.
