  • 3+31+31+30 = 95. Plus 25 = 25th October - and that's both ignoring their advice to others that they allow a three days early claim (I wouldn't rely on THAT!) and excluding the day of connection.
  • Hi, I have now received two emails saying your cheque will be posted in 10 days and it has been about two moths and nothing has arrived,
    If I send a LBA saying that I will file a claim via small courts, then do I say it will be for the whole cash back amount or just what I am owed until now which is £168?

    Their failure to pay on time is a fundamental breach of the contract.

    Send them a Letter Before Action pointing out this fundamental breach requesting them to pay you the full amount due under the contract within 7 days.

    If this is ignored, then your claim via MCOL, (providing you are confident they have the funds to make a court action worthwhile), should be for this plus court fees, plus interest on the late payment.

    I got a letter from PBD in Sep 07 saying that the payment will be made in the next 10 working days. But, till date, I haven’t received any payment and when I called them up they keep saying that the payment will be made in Nov ’07 (this month) but they cannot give an exact date.

    This payment is for my 300 days cashback claim of one of my orders. But, I have taken 3 new contracts with CNM and PBD in March this year and so, I am a bit worried that if I threaten them by LOA, it will affect my other orders. My first cashback claim for these three orders are also successful but yet to receive payment from them.

    Could you please let me know your thoughts?

    I gratefully appreciate your help!

    Trying to contact these cowboys is a joke !

    Tried calling 01270412345 and was told to call an 0190...... number. Any ideas?

    I was promised my 4th cashback check on 2 Oct within 10 days and am YET to receive despite several emails and attempted phone calls !

    Have these lot gone under ? Can anyone offer any help?

    You need to be sure that when sue, the defendant has the money to pay you when you win the case. If they can't pay you, then you end up with nothing - and also have had to bear all the cost of your court case, even though you have won it.

    I presume you are meaning a LBA (letter before action)?

    No. Taking action over one contract won't affect the situation on your others.

    sorry, i missed that! theres no way of being sure though is there? lol its a lose-lose situation with them!
  • I sent an LBA to Phoneboxdirect on Mon, as it had been 61 working days since they "received" the claim, and after them sending an e-mail on 4 Oct saying it had gone to cheque dept....10days...etc then not hearing anything even after e-mailing them on 30 Oct.
    Well today they emailed back acknowledging correspondance and saying they will get back in.......30 Yes 30 days!!!!

    To summarise:
    "Received" 20 Aug
    E-mailed with the 10 days etc, 04 Oct
    I emailed them 30 Oct, no answer.
    LBA sent Mon 12th
    Letter today saying they will get back to me in 30 days.

    So, before I file a claim online on Monday does anyone think a judge would find me unreasonable?
