I requested an email conformation to say my claim was ok, they said they had already sent one but they will send it again and that I needed to add them to my contact list so it is received and not put into junk. I went to add them as a contact and surprise surprise it was already there, I rang the next day and was told to email them and they will email me back, to my surprise they did that very day and said my claim was ok and I should receive cheque in November. If I had of left down to them I would of lost the whole claim as I was due to send my next bill off (the way the dates fell I had to send 2 clams in 2 months), if I hadn't and come November I would of received the first cheque I then would of been screwed as I hadn't sent the next claim off.

    ps the ones I sent were for CNM but the same and very close to that date. I have the PBD ones for May and they hadn't changed in the interim. I wouldn't send them a copy yet in any case. Send a LBA simply stating that at the time you took out your contract that wasn't a requirement.

    Thanks for the response MissG. But if they sent me a letter by accident, that's their problem and they should be accountable. Therefore I should just be sent the full amount because the process has become void. Either way, I guess I'll ring them and see what they have to say for themselves.

    MissG - good luck receiving your cheque in November! I reckon you'll probably have to allow a month on top (at least) of whatever they say!

    This was their reply to my dispatch dispute:

    Hello,

    Thank you for your email, The claim form that you signed and agreed to stated you need to send the handset despatch note. We did provide you with a link to a claim form when you placed your order to print out this claim form does state that you don't need a despatch note, we do have to update the link for new customers.
    You have submitted a new claim form and therefore had to submit your despatch note.

    What is our consensus on this? How should I reply? Should I begin a MCOL and then write back? Please assist.

    Is rubbish! What they are saying is that using a later link to get the same claim form changes your original t&c merely because in the interim THEY have changed the form. LBA then sue. Don't call them, just go the formal route now.
  • Hi, some advice please...
    my girlfriend put in her first claim on time, was accepted etc and on 4 October received an e-mail stating that her claim was authorised and would be sent to the cheque processing centre and they would contact in approx 10 working days to advise when the cheque is expected.
    Funnily enough... by 30 Oct had heard nothing so e-mailed them politely, asking when she could expect payment as it had now been 60 working days, and haven't heard anything since. I refuse to ring a premium number so on Monday will send an LBA giving them 7 days etc but just need to check a couple of things:

    1. The above is the address that I got from company house, is this correct?
    2. How much am I going to sue them for, the full contract or just the first claim? (Plus expenses obviously)
    3. Does anyone have a name for the letter as I don't like to be too impersonal;)

    Thanks in advance, I'll let you know how it goes. My girlfriend is quite worried but I quite like the odd bit of confrontation so this should be entertaining.
    You can't go wrong with carpet bombing...
  • My connection date was 27th June. My most recent bill is dated 25th Oct. Do I send that one or the next one? Please only answer if you know for sure. Its rather important!
