I've got my first claim coming up (Month 4) as I took my phone out on 27th June. My bill (with Orange) is dated 19th of the month. Does any one know FOR CERTAIN which bill I should be submitting? 19th October or the 19th November. i.e. the one AROUND the 27th or the one AFTER the 4 months/120 days have passed?

Still no cheque after receiving an email on the 10 sept claiming it would be with me in 10 days!
I just phoned again and got told that as it has been over 45 working days she would send it to processing to get sorted ASAP eerrrrmmm, what! It has been 66 working days, they are taking the mickey out of me now! when I phoned a few weeks ago, i was given some pathetic tale about my cheque being delayed by the postal strike even though it hadnt even been written yet and the strike was already over. Then she started bleating about not having enough cheques and it would be sent out next week, now I am being told it has got to go to processing!! I feel sorry for anyone who has taken out a contract with this shower recently!!
I said I would be going to MCOL if I have not recieved my cheque by Friday, do I need to put a LBA in the post today or can it be verbal?

Same position as you, except they sent me the "cheque will be with you in 10 working days" on 5th Sep. They said it was sent in the first week of October and I need to wait 30days after its been sent to start some sort of procedure if a cheque is lost!I think its to do with the strikes, the post here is on average 10days behind, I have sent loads of stuff via 1st class recorded mail between 5-7Oct and about half have been delivered!
Really regret taking another 2 contracts out June this year

Well after 15 months of dealing with phoneboxdirect, I am very happy to say that I can now walk away from them and there low down underhand ways for good!!!
Day 92 and I have finally recieved my final cashback cheque.... Just need to bank it and get it cleared, then I can forget all about the lying little toerags :j

I just checked and the Customer Care line has changed it's phone number from and 0870 number (08700 427 895) to a premium rate 0901 0901 5540066 number. With no mention of how much it costs. Sounds like a call to ITCSIS!

Simple solution is just to send emails.
No point in speaking to them anyway, they just lie.0 -
I thought I'd post my experience with Phoneboxdirect (PBD). Last year I had a 12 month cashback contract with e2save, and it worked fine - I sent the bill and claim form in every few months and got a cheque back quickly and hassle free.
When this expired I found a good cashback deal with PBD and signed up.
In July my first claim was due so I sent in all paperwork by registered mail. Over Aug/Sept I got frequent emails confirming with claim was being reviewed, and on 8 Oct I got an email confirming my claim had been authorised for payment and a cheque would arrive within 10 days (NB: email rec'd 60 days after I had sent in the paperwork!!)
This week, I got a letter saying my claim had been declined and I wouldnt not be entitled to any further claims - ie I have just lost £420 worth of cashbacks! Reason: despatch notice wasnt included in the paperwork.
This had me totally confused as I had no recollection of this requirement and I am quite a detailed and thorough person so I dont normally miss things like this. However when I went to the T&C on their website, the despatch notice requirement was there! Thinking I was going mad, I found my original claim form and contract and noticed that there was NO MENTION of the need for a despatch form!
Unfortunately, altho I had prepared my claim based on the original claim form, I made a typo just before sending so I went to their website, printed a new one out, filled it out the same way I had the original, and sent it off, not realising they had changed the form.
PBD claim that because I used a new form and thereby agreed to their updated T&C, its 'not their fault'.
I am disgusted that this company is out there making sneaky but onerous changes to their forms and T&C, and not making it clear to existing customers that changes have occured - even though the outcome is that customers will lose 12-24 months worth of claims! My only conclusion can be that they do this intentionally in order to make claiming correctly as difficult as possible. It must save them a fortune!
Can someone advise me what to do next. I sent them a Letter before action, but got a one line email back saying its not their fault I signed up to the new T&C by using an updated form, and that this made the claim and all future claims void.
Do I have a case here under to Unfair Terms and Conditions Regs? I want to bring this dodgy, scamming company to account!0 -
Their reply to your LBA doesn't negate it.
You sent it giving them a deadline to pay you the money they owed you.
As they haven't paid you, and you did submit your claim in line with the contract conditions you can now continue to pursue them for the money.
In not paying you they have committed a relevant breach of the contract, so you can now issue a summons for the full amount due on the contract, not just the unpaid instalment.0 -
Thanks. Could they argue that I have contracted myself to their new T&C because I signed the updated T&C form? I fear this is how they will protect themselves!0
