I'm afraid despite their shortcomings recently I cannot agree. The t&c are extremely clear on this point; they tell you to keep a copy of the reference number at the point of ordering on-line; not afterwards in any other document. I was ready and waiting for that number as I went into the ordering system. Too many people seem to wait until later to work through what's required; that is a very costly and completely (usually) avoidable mistake, I'm afraid. That's not to say they are justified in denying your claims over this. However, ALL these deals (and dealers) operate in a way which is designed to filter out a proportion of claims, otherwise they wouldn't be able to offer the deals. It's a fact of life. Where I do disagree with them is where things are done entirely properly with very careful forethought and attention to detail and THEN they don't pay.
Sometimes people come onto these threads and castigate anyone for doing the deals since they are obviously "too good to be true". Whilst there is an element of truth in that I disagree with the conclusion. However, anyone going into these deals MUST see quite clearly that everyone CANNOT get all the cashback promised; it just doesn't add up! Therefore NO-ONE should do it at ALL unless they have thoroughly researched everything, recognised the risks and fully understand how everything works - and a lot more besides. Would many actually buy like this from a stranger knocking on their door? I very much doubt it! Yet a colourful website without even having to talk with anyone works wonders. If anyone thinks they've been treated against the t&c sue; otherwise they only have themselves to blame either because THEY slipped up OR because they were prepared to order on-line but not prepared to spend a similar amount of time on-line filing at moneyclaim.
As a comment in defence of my apparent harshness, I will point out that my own LBA has just gone out for entirely different reasons. I was ready, willing and able from day one to do that if required even though I hoped not to. I will get all my cashbacks provided they're still around when they fall due and would consider another contract once things settle down and depending what's on offer. However, I am under no illusions whatever and have weighed up the risks accordingly and take steps to avoid all the basic (and nowadays some less basic) pitfalls.0 -

Mobilejunkie - in theory I agree with you however I do think the Unfair Terms in Consumer Contracts Regulations make these T&C unenforceable. As I say I think they should be allowed strict T&C as long as they are clearly stated but the powers that be seem to want to overrule this.I think....0

I have had the same problem. I sent a claim form off with wrong order ref numbers! if you decide to take this further count me in! I do not know who to contact? any ideas any 1? This is day-light robbery!:mad:
I fully intend to pursue this through the courts, regardless of outcome. There is no way for me to know what a Judge will rule until the arguments are made..... In my case, prior to despatch of goods, a full month passed since my original order (and their original emails), so when I received the order finally with a reference no. at the top of the attached letter I naturally assumed this is the "latest" reference no was the one that related to my order. In hindsight, it is easy to see where I've we may have gone wrong, but I do not seem to be the only person to have been misled into thinking the latter reference was the one to use. I think once this goes to court we can let them ascertain what is a fair basis for refusal, given that PBD claim they could not identify my cashback claim based on the latter number but ironically could advise receipt of application and refusal of my cashback using correct reference no. Indeed, I had even sent them a copy of the despatch note (even though I needn't for my specific claim) so that they could fully identify me as a customer.
I would urge anyone else in the same situation to pursue this through the Small Claims Court. I would rather pay the additional court fees than give up on £420 without a struggle.....0 -

I am not sure what your "LBA" is...
I sent my second claim form in to PBD, everything complete, checked by a third party, received by them within the time limit, but they sent a letter claiming that a crucial page of my phone bill was not included and so my "claims have become invalid and invalidates all future claims". I spoke to numerous unhelpful people, not help whatsoever. What can a person do in this case? They refuse to even address the issue that the relevant document was "lost" in their system.
So, even if you file correctly and in time, they will find some way to keep from paying what they owe.0 -
No problem; puts you in a very good position. Letter Before Action giving them (say) 10 days to reinstate and pay your claim or file on Moneyclaim for ALL the cashback plus court costs and statutory interest. That's providing you kept full copies and can prove on the balance of probabilites that you DID include everything.0

Thanks mobilejunkie. I have kept every scrap of paper and email generated from this carry on. What pain it has been. I don't have any sir names of the people I spoke to on the phone, they were very cagey about giving last names.0

Guess what!? Another change in their t&c. Even the "45 days" is now more ambiguous. 18 month contracts have 6 claims, mostly in successive months right at the end – so you’ll have to wait about 2 YEARS for your money IF they’re still around, at the present decay in payment timescales continue. What’s the betting they’ll try it on with existing 18 month contracts now and attempt to enforce the new t&c rather than the ones people signed up to recently? No prizes for the answer!
