  • I was wondering if anybody here may be able to help me. I'm in a similar situation as Nationwide Airlines have just gone out of business and taken my money with them. i paid with VISA debit card. Does anybody know if I may have any success in getting my money back?

    Any help would be appreciated. Thanks.

    ask for a visa debit chargeback form, you'll most likely to get the money quicker than any of us who has paid via credit card...

    Section 75 Consumer Credit Act

    For a credit card company to be liable, the cash price of the goods or service must be over £100 and under £30,000 and there must be a claim for breach of contract (or misrepresentation) against the supplier. If these requirements are satisfied, you then have a claim against the supplier and/or the credit card company.
    Practically speaking it's advisable to complain first to the supplier because the supplier may deal satisfactorily with your claim (for example, by replacing defective goods or refunding the price). It's when a supplier is uncooperative or insolvent that you should think about claiming against the credit card company.
    First of all, ensure that you have a valid claim against the supplier and try to establish what it's worth (for instance, in the case of defective work this will mean obtaining a few quotations for the cost of remedying the problem). Then write to the credit card company detailing the problem and enclosing any supporting evidence (such as copy quotations). Also state in the letter that you'll be withholding an appropriate sum (by way of compensation) from your credit card account and that you shouldn't be charged interest on that sum.
    At first you may get a negative response from the credit card company, but if you feel sure that you have a valid claim, stick to your guns!
    Practical advice
    • Pursue any claims initially against the supplier (who's directly liable for any breach of contract or misrepresentation).
    • If you intend to withhold money from the credit card company, you must be able to establish a claim against the supplier and write to the credit card company explaining what you're doing and why.
    • If you have a valid claim, don't be deterred by a negative and/or intimidating response from the credit card company.

    After my phone calls w/ Halifax, turns out they never filled the form (non fraudulent atm debit transaction) over the phone and i had to go in branch this morning to sort it out- more waiting around!
    But luckily @ this branch of halifax they knew what i was talking abt- been to other branches and they fobbe dme off w/ a u'll have to talk to oasis...
    Persistance is the key!
    I'll update on teh progress when somethinng happens

    FINALLY! HSBC has just called me and said they are calling from the chargeback department and the money will be credited back into my account within the next 48 hours!

    As for the additional costs they said they need to pass that to their legal department and they will let me know what will happen.

    don't bother going to the dispute deparatment, write a letter to the 'Internal chargeback department' stating that you will not persue the claims from Oasis and request a chargeback from HSBC.

    Hopefully I will get my additional money back for the extra costs, im not too bothered about that but it would be a bonus if i did get that. :T

    yeah it is a relief, had to go through 3 different departments and lucky enough got to the right one.

    1) HSBC Claims department < ---- customer service people, only issue you forms to sign

    2) HSBC Dispute department <
    Fobbed me off a million times and eventually told me to write a letter to internal chargeback department

    3) HSBC Chargeback department <
    wrote ONE letter to them and got an instant response saying they will credit my account within 48 hours....


    talk about them making it difficult for us...

    well done!!!! i think my letters have been going to the dispute chargebacks department....Is there address in southend-on-sea, essex???
    When you wrote your letter to them, did you send off all the documents as well? I sent off a letter today, enclosing my documents, AGAIN. as well as a letter stating that i will pursuing my claim against HSBC ONLY. hope it works!!!!!
