    I totally agree - play the long game and if you suceed take it as a bonus. Tesco does not have to operate the refund policy that it chooses to offer - no other supermarket does.

    If people huff and puff and threaten Trading Standards, ultimately Tesco will pull their refund policy.

    I spoke to TS about this area and they said that Tesco are under no obligation to operate the refund policy that they offer - additionally they went on to say that the overcharge is a trading offence, but that the refund could be refused and it would then be a civil matter for the customer to pursue as a breach of contract - not a trading offence.

    So, take it easy and relax.

    Those advocating the hard line approach should see what response there is from Asda to a pricing overcharge!! No prisoners are taken there.

    Spot on, current misprice in Asda Pineapple chunks @ 38p scanning @ 48p 10p refund plus £2 credit net profit £2 if you don't like pineapple chunks (although I'm sure the salvation army would appreciate the donation) you make a mere profit of just £1.52 on the transaction not a lot but a bite back nonetheless

    I have to take issue with Quiet Advisor who says that Tesco are not obliged to honour the offer. It is an offence under Section 14 of the Trade Descriptions Act. If Tesco offer the service or facility (the refund policy) then they are required to honour it. To offer it then refuse to honour it leaves them liable to prosecution, subject to the statutory defences. And defences are hardly relevant when you simply refuse to honour a policy which is on the wall at the CS desk.

    "It shall be an offence for any person in the course of any trade or business
    (a) to make a statement which he knows to be false; or
    (b) recklessly to make a statement which is false; as to any of the following matters, that is to say:
    (i)the provision in the course of any trade or business of any services, accommodation or facilities."


    I am surprised that your local TS office can give out such incorrect information. Any TSO worth his salt knows Section 14 inside out. He will also know that the staff member refusing the policy is personally liable to prosecution as well as the company.

    Got my first mis-price refund last night. I'm normally in too much of a hurry to be able to browse the chilled foods.
    Got 2 packs of Tesco Value Red Leicester medium size
    shelf price £3.89/kg
    pack price £3.96/kg
    I normally buy strong or farmhouse chedder, but I'm sure this will taste fine.

    I also got 12 packs of Birdseye beef & 600 points which is rare - they're always sold out in my 3 locals. I did leave some for others.

    And I bought 6 Suns for the Subway vouchers as we're off on hols in a couple of days and this will save me making packed lunch (and my daughter got addicted to their meatball sub in Australia last year).

    And I found some clearance chocolate at half price
    Nestle Double Choc (100g) - 32p
    Swiss Delice Brownie Choc (100g) - 44p

    And then at the tills I got a young assistant who really made the trip for me, she remembered me from another visit and chatted away telling me it was her last week as Tesco - she had had an interview for a full time job as a care assistant in an old people's home (where she was working on Saturdays) at much better pay than Tescos at £8 per hour and she was so excited as they had just phoned her to tell her she had got the job and she was starting in a weeks time. Its the job she had always wanted - she loves working there. What a fantastic girl.

    And she took 3 Joey vouchers in a shop that normally will only take 10%.

    Just a little shopping trip, but oh so satisfying.

    Just been into my local Tesco and picked up 2 packs of Gammon Joint 750g priced at £4.13, scanned at £4.13 but the shelf label said £3.94. Trundled off to CS and said I've been overcharged. CS told me to wait whilst she checked the shelf, came back and said that was right and cos they'd overcharged I'd get items for free. I innocently(!) said Thanks and can I get some more. She said it's not up to her to change the labels on the shelf just to do the refunds. Get as many as you want!
    I only took 3 more but noticed that the larger joints were also mispriced.
    Tesco gave me £20 worth of meat for free!!!!

    i have been getting lost for wigan tesco and evertime they always keep you for 20mins or more

    Just come back from my local Tesco's where gammon was also mispriced. Managed to get £30 worth of meat free, plus the girl took £25 worth of money off vouchers also obtained via recommendations from this site. I am off bowling tonight using my Tesco Clubcard deal vouchers, so they are flavour of the month in my house at the moment. Thanks for the tip, I have never bothered looking before. An extra few minutes on my shopping time has paid off for me

    Just done this (on purpose) for the first time, and they made me work for it!

    I was "genuinely" overcharged last week for a reduced to clear item where they scanned the original barcode instead, so I took that back and got the refund no problem. This made me brave enough to go looking for misprices!

    Found 2 packs of rump steak marked at £8.03/kg instead of shelf price £7.98/kg. This was in the Tesco Metro on Stroud Green Road, London in case anyone wants to look for more. There were also a couple of packs at £7.98/kg.

    Bought steak and they charged £8.03/kg, so went back in, double checked the shelf price and picked up a pack at £7.98/kg to take to CS in case proof was needed...

    First girl at CS kept saying that the price varied by weight, and didn't seem to (want to) understand that yes, pack price does vary, but price per kilo should stay the same.

    Supervisor understood this point, but went off to "check things" for a good 5 mins, then came back saying that the price had gone up and she would refund the difference if I really wanted, but that the price on the packet always overrides the shelf price so I should have expected to pay the price on the packet. I asked for a full refund and to keep it, and pointed out the CS policy next to her and she still wouldn't have it. It was the newer version mentioning price on shelf or price on packet. She said that since there was no difference between what I'd paid and price on packet, shelf price didn't matter. Eventually she said she couldn't authorise it so had to call the manager. She put a call in then disappeared.

    Manager arrived after another 10 mins and immediately said that she wanted me to come with her to check the shelf price. I've read previous posts on here about sneaky removal of shelf tickets but couldn't believe they would actually DO that. Of course there was no ticket there.

    So what are you supposed to do in that situation? Accuse their staff? I just kept saying that it had been there when I bought the meat and it had gone now so it must have been moved. Thankfully I had the £7.98/kg packet as proof, which was actually dated later than the ones I'd bought so their "price rise" theory didn't work. She asked me in a very patronising tone whether I had really expected to pay £7.98/kg when the packets said £8.03/kg, as if I must have been stupid for thinking this. I said that I was entitled by Trading Standards to assume the lower price. Eventually she said that she would go and ask the supervisor whether she'd moved the labels, so told me to go back to the CS desk and wait while she did that.

    Finally she came back and WITHOUT A WORD put through my full refund, in fact the only thing she said to me from coming back until I left the store was to ask me to enter my PIN. No acknowledgement and certainly no apology. Miserable cow, she looked so annoyed!

    Anyway, I probably won't do it again as I don't eat much meat so this will last me for a month at least and it involves way too much conflict for me!
