    and have recieved aletter saying they will deal with my claim independantly
    after the court case ect

    do i wait this 8 weeks i seem to be seeing
    or threaten with court

    Hi everyone

    I am in a big argument with HSBC regarding a lot of charges which were piled on my account back in December.
    Their call centre called me at work and advised me that as I had exceeded my overdraft limit two months running, they were cancelling all my automatic payments ie direct debits and standing orders. This call was received four days before my holiday so I am sure you can understand I was furious. I quickly completed account transfer forms to switch everything over to my Nationwide account. However, whilst I was on holiday, HSBC charged me almost £400 for reversing Direct Debits they had told me they had cancelled! :mad:

    6 months later, HSBC are claiming I misheard or misunderstood their call centre staff and that they would never had said that. they are stating that the charges are valid as the reversals were caused by me transferring my salary etc to a new account.

    As most banks record calls, can I ask for a copy of the recording to prove my case or is this impossible?

    Anyone know

    As far as i know you can request the calls under the Data Protection Act. I think there are posts already on this site that talk about that.

    I'm surprised they haven't done so themselves... when I had a debate with Halifax, they played all the phonecalls back to establish who'd said what, and fair enough found me to be correct.

    You should certainly be able to claim it under DPA as suggested - the difficulty could be in the "calls may be recorded..."

    I have just posted this on the main 'Reclaim your charges' forum, then spotted the bank-specific threads. So apologies for asking twice.

    My husband had a business account with HSBC, now closed. I've got the last six years statements and there were hefty charges applied - often £70 or £80 in a month despite very few transactions.

    Does anyone know whether we can claim these back? My husband says they are 'normal' account charges for a business account. I think he's in denial as he was constantly over his overdraft limit. Any advice welcome.

    Hello People,

    I bank with HSBC, and I have an overdraft limit of £500, which I rarely use nowadays, but have crept in to as I have just completed a house purchase, so have had a few one off costs etc.

    I exceeded my limit by £1.44 (for a McDonalds which makes it even more gaulling!), and once realised transferred some money over to take me below again. It was less than 24 hours I was over, and nothing has come on to my account about a charge, although I recall it is usually the following month.

    I have successfully reclaimed charges from them previously, before the test case commenced (with the help of MSE I hasten to add), and I am wondering if it is worth ringing them to see if they will waive this one instance. I have done this with Halifax and I wondered if anyone has had any recent experience of this with the good folk of HSBC?

    Could go into branch next time you're in town and ask them?
  • Go into the bank and speak to them rather than making a phone call.

    If you need to make a phone call re overdraft limit go to the branch and use theirs whenever you can. My bank does not allow you to reduce overdrafts over the counter - you always have to phone so if it is going to use up their phone, a desk and computer thats their loss.

    Use to work for HSBC call centre on the complaints & audit team and EVERYTHING is recorded. You also have the right to listen to the call, they can play it to you over the phone or go into a local branch where they can play you a copy of the tape.

    Make sure you make a formal complaint and say you are disputing what was discussed in the call on <insert date here> and you want them check the call and provide you with a copy if they dispute what you are saying.
