    Hiya, If you are in financial difficulty under the terms of the waiver, although you may not get the charges back, it has to be worth a letter to hsbc asking them to consider your case under the terms of the waiver for hardship cases.

    New waiver guidelines thus:-

    2.
    In making an assessment of financial difficulty the firm will take into account:
    a.
    evidence of changes in lifestyle, including loss of employment; disability; serious illness; imprisonment; relationship breakdown; death of a partner; starting a lower paid job; parental/carer leave; and starting full-time education;
    b.
    evidence of the following events:
    i.
    items repeatedly being returned unpaid due to lack of available funds;
    ii.
    failing to make loan repayments or other commitments;
    iii.
    discontinuation of regular credits;
    iv.
    notification of some form of insolvency or court proceedings;
    v.
    regular requests for increased borrowing or repeated rescheduling of debts;
    vi.
    making frequent cash withdrawals on a credit card at a non-promotional rate of interest; and
    vii.
    repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty).

    How would I go about wording a letter to HSBC about the following. Do I have to have proof of the following or is the fact that I was charged so many times by them enough ??? At the time, I was going through difficulties with a lower paid job but cant really prove that but I ended up missing payments on other companies the same as I did with HSBC and in turn borrowed more from HSBC.

    Is there specific wording I need to put in a letter or do I just write to them and state my difficulties at the time and now and ask them to call off reclaiming debt ??? Its gone to a debt collection now though.???

    As its now a debt I owe them would they still be able to consider refunding charges to lessen the debt by mentioning the waiver???

    ive just gone through all my credit card bills from HSBC dating back to 2003. i was either over the limit or behind on payments for over a year, yet i can only find two "arrears charge"s for £20 each over that period.

    is this normal? i really expected there to be a hell of a lot more. there is no point requesting the info from there as i have all the statements in front of me.

    i was just wondering if anyone could shed any light on it?

  • Over the past 4 months HSBC have charged me £400 for goin over my overdraft (mainly due to these charges) i have a copy of the templates but i am concerned it will be taken to court and i am slightly worried as im not sure what exactly happens if it goes that far; do i need a laywer and roughly how mch will it cost in time and money f court action does take place. i have been charged a small amount in the past and im not too concerned about claiming these back just the charges from the last 4 months.
    could anyone give me any advice on what i should please

    Hello

    One of my residents at work said that HSBC had contacted her and said that the test case had been sucessful but that she has to pay £39 for paperwork to get her charges back, has anyone heard of this?

    She wouldn't give her bank details and they said they will ring back on the 12th for them :confused:

    Sorry I missed your post - the simplest way is to list the waiver terms I posted further up this thread and answer each point, then include your income expenditure sheet and they will go from that point.

    Yes any refund would be used to reduce the debt owing and you would negotiate a repayment deal on the remaining sum

    I'm at my wits end with HSBC!!

    Ive been trying to claim hardship and explained how the charges are throwing me deeper into debt (£100-£150 at a time) but they are refusing to acknowledge me. They also told me on 17th sept they will be taking another £100 from when i went over my overdraft on 4th August. With a lot of help from family, i had managed to get myself into credit on my account, but this charge is going to put me in my overdraft yet again (luckily not over it). I just dont know what else i can do now :-(
