I'm at my wits end with HSBC!!
Ive been trying to claim hardship and explained how the charges are throwing me deeper into debt (£100-£150 at a time) but they are refusing to acknowledge me. They also told me on 17th sept they will be taking another £100 from when i went over my overdraft on 4th August. With a lot of help from family, i had managed to get myself into credit on my account, but this charge is going to put me in my overdraft yet again (luckily not over it). I just dont know what else i can do now :-(
Get out ! If you are stuck in a circle of charges change accounts. Get your income paid elsewhere and make an arrangement with HSBC to repy any overdraft. Don't get an overdraft at the new bank - its an expensive loan and you can only spend it once.LegalBeagles0 -
HI, sent off my first letter for reclaiming under fiancial hardship. currently dealing with consumer credit counselling services and going to court soon over mortgages arrears (on a seperate note this is the first time i've ever been to court for anything what should i expect any tips)
anyway just had letter back from hsbc they say:
IF MY UNDERSTANDING OF THE POSITION IS CORRECT IN ADDITION TO DISPUTING THE LEGALITY OF THE LEVEL OF CHARGES PASSED TO YOUR ACCOUNT YOU ALLEGE THAT THE BANK HAS UNLAWFULLY DEDUCTED CHARGES FROM YOUR ACCOUNT IN CONTRAVENTION OF S187 OF THE SOCIAL SECURITY ADMIN ACT 1982.
no i haven't i just sent the standard download letter off claiming hardship. i don't get social security. we both work.
THEN THEY SAY BECAUSE OF MY ALLEGATIONS IT WAS REFERRED TO THE BANKS LEGAL ADVISORS.
AND THEY SAID THAT I HAVE CONFUSED CHARGES IN THE SENSE OF FEES, TO WHICH THE ACT HAS NO RELEVANCE AND CHARGES IN THE SENSE OF A PROPREITARY RIGHT ATTACHING TO BENEFITS TO WHICH THE ACT RELATES, BUT WHICH THE LEVYING OF FEES ON OVERDRAFTS DOES NOT CREATE.
I ACKNOWLEDGE THAT THE ONLY SOURCE OF INCOME INTO THE ACCOUNT IS DERIVED FROM STATE BENEFITS, HOWEVER YOUR ACCOUNT IS GOVERNED BY THE BANKS STIPULATED TERMS AND CONDITIONS AND BY CONDUCTING YOUR ACCOUNT AS YOU HAVE THEN CHARGES HAVE BEEN DEDUCTED FROM YOUR ACCOUNT
do any of you understand this cause i'm at a loss. they say they have noted my complaint but i have to wait for the result of the test case.
then they say please get in touch and we will try to help you as your in financial difficulties.0 -

I've just had a thought...... My letter from the court (back in August 2007..) said that my case would be stayed until the court case was complete or October 2008.
I'm sure others out there have already had there interim date - what happens. Should I wait for another letter from the court or go to court on the date? I need to get all my paperwork sorted (I've moved house again and am very disorganised at the moment) but if anyone can give me a quick response that'd be fab.
If not I'm off home tonight to start scratting in boxes to find the letter from the court (which I have no idea where it is!) but I'm positive I told them I'd moved house so now I'm panicking that its gone to my old address.... oh heck!

So glad I've found this thread. I've had an ongoing battle with HSBC for a number of months now and my hubby nad I fianlly got to the last straw last week and sent off our re-claim paperwork.
I orginally sent a letter detailing all of their failings (3 pages of them!) and I got a response saying sorry and to call them re: financial hardship. I called and they said they would call me back. They never have. I have called on 3 occasions and left my correct numbers and I got a letter last week saying that they have failed to get in touch with me and I'm to call them! They have my mobile...which is always with me. I have not had any missed calls. I've checked and it's on my contacts on my internet banking!
Hubby said that i have given them a chance and I should just play them at their own game so we have sent our LBA off recorded delivery.
Should we expect any form of response? Expecially given the previous conversations? Or will it just be a thanks but you'll have to wait?
I would like to think that given the fact that they have messed up that I would at least get some kind of help but then agan it's HSBC.....

I've had exactly the same letter this morning from them! I did state that I have having finiancial difficulties as I was on jobseekers allowance but I used the standard letter template and didn't say that this was my only form of income which is what the letter implies (as my husband is still working).
I'm not sure where to go from here so if anyone had any suggestions? I am scared that if I ring them they will just talk me into getting a loan or an overdraft to put me right which I most definitely DON'T want! i just want the unfair charges retuned i.e. £1485. I successfully reclaimed £2850 from them 18 months ago.

Hardship peeps - can someone point me to the hardship letter template please:)
From what you have both said sound like they have sent the wrong template letter to you, but check you didnt mention the social security administration act in the letters, as i assume ones that do get stuck in the 'interpretation of the law is wrong template letter' pile rather than the ' hardship possible send an income expenditure form to them template letter' pile.

You'll still be on hold, nothings moved yet in the test case.
People you see coming through with claims now are those with hardship who are exempt from the waiver. So i wouldnt worry, but I would call the court with your claim number and ask them to check the change of address is on your file. Just to set your mind at rest and save box scrabbling.LegalBeagles0 -
So glad I found someone to rant about HSBC. They clearly must be the worst bank in the world. In 2008 I have complained so many times on behalf of my parents. All they want is money and are not prepared to help people at all. Here's what bugs me about them the most.
1) Trying to claim my dad's charges under hardship rules but they won't help. It's now with FOS. My dad was very ill end 2006 and didn't return to work till 2008. Ever since he has been trying to reduce his overdraft whilst working all hours and making his regular payments. HSBC think nothing of charging him £200 a time in fees making over £1000 of charges in about 6 months. But they still say he is fine and they can't do anything. My dad asked if they could up his overdraft just a couple of hundred pounds so that he didn't go over it every months. This would save £200 of charges which would reduce the overdraft.
2) Dealing with HSBC taking £200 from my mum's account but saying it's not them. Whilst trying to take £200 from an ATM it said there was unsufficient funds. She therefore tried £100 instead. When her statement came it showed the £200 transaction which was rejected and the £100. After investiagating they say the balance and machine was right so they won't be refunding. Just HSBC stealing money from their customers and calling them liars.
As soon as I have cleared my overdraft with the bank I will be closing the account. Hmm I've just been doing my tot up over the 4 years ive had my account looking at what hsbc have charged and i have a couple questions.
What is a fine for an UNPAID ITEM (as it says on my statement, back in 2005) and can I claim? And can i claim back OD arrangement fees?
Even so my total money owed including those two is a mere £120? Is it worth it for me considering im transfering accounts. HSBC have treated me like pants ove the years so im slightly tempted to do one on them. What do you think?
