If you aren't going the hardship route you will need to wait for the outcome of the court case.
beddi havent been on here for sooo long id almost forgot i was reclaiming!! i have heard nothing at all since 9/6/08!! im assuming im still playing the waiting game? my case is with the delightful HSBC, and was originally filed in april 07, i am not in a hardship case albeit that doesnt mean i would not like my money some time this century, should i continue very very patiently waiting (to the point of almost forgetting) or should i be chasing this up in anyway. sorry if the question has been asked previously. i am very grateful for any response0 -

I'm new to the forums but have been browsing them for a couple of weeks, and would like some advice please.
I had my HSBC account closed in 2006 after charges took me past my overdraft limit of £1000 to over 1700. I believe I'm owed in excess of £5000 in charges and was wondering if they have to refund these charges as the account is closed? I receive £45 a week carers allowance as I look after my father fulltime and struggle to meet my rent, council tax and several credit card payments every month. I'm unable to enjoy a social life and am in my opinion in severe financial hardship. Any advice would be sincerely appreciated.

I am sorry for sounding naive... but here goes...
I logged onto my HSBC bank account and saw the message saying "Charges and debit interest incurred for banking services" amounting to 25p... I don't know why? I have an Overdraft limit of £200 which I havent gone over.0 -

Hey all wise ones,
Can you help with my next move, i am claiming £1600 of charges now from HSBC due to financial hardship that have been on hold since 2007 - currently we are trying to exist on £40 per week Tax Credits with a new claim for JSA income based being AWOL in the system (had to go for a crisis loan today for food infact!) and i've had a reply from HSBC today.

Thanks for your letter .... blah blah.
We would like to help by carrying out a review of your individual circumstances with you as part of the review we will be able to verify if you are in hardship etc..
Subject to that verification we will explore with you what we may be able to do to assist. This will include considering wether some or all of any current debt can be re-scheduled or wether alternative borrowing arrangements could be put in place. The fact that you have incurred overdraft charges and are claiming a refund of those charges will form part of our overall assessment of your circumstances (as will all relevant factors) but our focus will be on considering what we may be able to do to assist, not solely considering refunding charges as you have requested.
Enclosed is our leaflet... blah blah It contains an income and expenditure form which if you would like to speak to us about your circumstances we will need you to complete
Once you have completed the I&E form please call us.

Assuming they accept you are in Financial Hardship, they are likely to offer an amount to cover arrears payments for the next 2 months, and to be re-assessed then

Sorry to sound dumb, but what's an "I&E Form"?
Should I ring up and see what they can offer?
I've already got a loan with HSBC, and apparently I can't consolidate the loan and borrow a bit more for another couple of payments....
