    Really could do with some help or advice on this if anyone would be willing to…

    Well I applied for my bank charges to be paid back to me in early March and this was done so, and I received £800 in May. Well I am not very good with my finances and I have been since been charged £660 in charges to date.

    I filed a second request off using the template letters to HSBC requesting these to be paid back and I have received a letter stating:

    ‘Please note that HSBC and a group of other banks have agreed to start a court case with the Office of Fair Trading to decide on the legality of overdraft charging.

    As such, banks will no longer be processing complaints from customers who want to reclaim their overdraft fees. Instead, customer claims or complaints will be recorded pending the outcome of the test case.

    In this instance, please be informed that we have registered your claim and you will be receiving a letter acknowledging this.

    The test case is expected to take more than a year. When a final decision is reached in the test case, we will contact you as soon as possible to tell you how we will resolve your complaint.’

    What would I need to do now, or what could I do? Am I to leave it or persist with claiming back on my charges?

  • Hi. I am new to this site and could really do with the same sort of advice!

    I successfully reclaimed £800 back from Lloyds TSB in April/May and have recently started to struggle again financially. I have been charged roughly £300 over the last couple of months and really want to reclaim that back too.

    Is reclaiming a second time completely impossible?? Shall I write them a letter even though all claims have been waived?

    I sent a cheque for £10 to HSBC last week, asking for a list of charges to my account for the last 6 years. Got a lovely (!) letter back, saying they had ripped up my cheque, and sent me a list of my charges, and a lengthy letter assuming that I was going to try to reclaim my charges. The letter is 3 pages long!! Next step, letter to them asking for a refund.

    I have just started reclaiming bank charges.
    I have started recieving statements for the the last 6 years.
    Just wanted to know if i need to write to the bank requesting for all the charges they have made on account also?
    please let me know whati should do.

    hi all, i just had all my statements back from the last 6 yrs, last week, and i didnt even send a tenner, i just asked and got.... and that was with the halifax.....it surprised me......anyway, i have sent the letter asking for the amount back (£1071), even told them that if they refund me pretty quick, i will accept £900, (without prejudice) thats letting them off with the full amount, plus all the interest... can only see what happens, maybe nothing because of the testcase.....;)
    Corduroy pillows are making headlines! Back home in London now after 27years wait! Duvet know it's Christmas, not original, it's a cover.

    Good luck with your claim.
    My latest claim for £900 total agaist The G M credit card has been stayed twice and the court quoted the test case even though the charges are on a credit card account. Have sent the template letter to un stay the case still waiting.

  • Hi,
    I used the letter template that Martin provided, and enclosed a £10 cheque, and it was as simple as that! maybe if you send the same letter, but edit it so that you don't send the cheque, you might get the list anyway and still get away without paying! Its definitely worth a try..good luck!
