  • I currently have two claims for unfair bank charges made against HSBC. One is for charges made against a personal account I had with HSBC. I have today been informed that they are going to defend the whole amount and that the claim can now not be continued on line through Money Claim. The claim is to be transferred to an appropriate court and I assume that they will ask the Court for a "stay" on this case until after the hearing in January - and any subsequent appeal.

    The second claim is for charges applied to a business account I had with HSBC. I believe that I read somewhere that banks were still dealing with reclaims made where the account concerned was a business account. Again, I have been informed that the defendant disputes the whole amount and that I am unable to proceed on line through Money Claim. The claim "will be transferred to the appropriate court for continuation". Does anyone know if I will need to attend court for the business account charges reclaim and what the procedure is?

    Any help/advice for both account types would be greatly appreciated.

  • I'm one of the thousands who have a claim in process but its being held up whilst the law courts get bought by the banks and we potentially continue to get ripped off. A friend of mine works at HSBC and says there is a rumour circulating that the outcome will be that any claims sent before the ruling will be honoured but any further claims will be rejected, has anyone else heard this?

    Is it worth me now claiming back from Nationwide and Lloyds TSB before the ruling is decided so that they cant say my claim was not already being processed? I wanted to see how the HSBC claim went before I began to do battle with the others but now I fear I may have left it too late. Any ideas or suggestions?

    The important bit is that it is a rumor..

    Unless there is some serious criminal activity going on & the judgement has been decided before the case has even begun, I would treat it as just that.. a rumor.. ;)
    It is worth getting your claim in asap though. The sooner you do it, the sooner it will get settled once the case is over.

    I reclaimed my bank charges (from my current account) with HSBC September 2006. I took their offer (which was less than i was claiming) but i needed the money.

    I remember signing something which basically said i agreed with their offer, but im sure it said something like i was also agreeing that i would not claim again.

    Has anyone else done this?

    I need to know because i have just been made redundant and i know i have been charged around £500 at least recently in charges on CC and bank account.

  • I claimed twice against the Abbey so it can be done, depends what you wrote in your acceptance letter.

    That clause would also be unenforceable..

    If I took a gun & shot off your foot and went to prison, then came & shot off your other foot when I got out, would you accept it if I said "hey you can't do anything about it because you already prosecuted me once for shooting off your foot"?

    Its the same principle. ;)

  • After the test case, does everyone get their 6 years worth of money back? Do you have to claim it or would they do it automatically for everyone without claims? I'm confused..!

  • iv just noticed that HSBC have been taking bank charges out my account for going over drawen, they have not notified me that they are going to take this money. they have taken £50 the last couple of month but this month it was £150 when i caled to see why i was told that it was becasue 3 direct debts had gone out while i was OD.

    Can i get these charges back?

    this has just topped off a year of me unsatisfied with HSBC. It started with them changing the name on my CC, my shares account, and a current account, then sending out cards to this person in his name ( i had asked for the current account to be changed as was a old shared house bills account). They then put up my credit card intrest by 7%, again without telling me (this has now been brought down) and was kept at that rate for 3 months befor i noticed.

    what would my next steps be?
