  • Has anyone else (there must be loads of you) received a letter from HSBC saying you have to pay an arrangement fee of £25 for your overdraft?
    As far as I'm aware the overdraft is already arranged, being over 6 years old. The charge has now come out of my account contributing to me being over my limit again.Could it be because I asked for and received a statement of my charges? These amount to nearly £500.
    Can they do this out of the blue?
    What if I refuse the new terms and cancel my account (which is -£900 of a £1500 overdraft), how do I go about that and how do I pay them back- would it be worth my while transfering the OD to a new account?
    Questions, questions!!!

  • I was a t the court stage just when the Test Case/staying came in. I'm a bit stuck now - I entered judgement which they defaulted and requested a stay.
    I received a N24 General form of judgement or order a couple of weeks ago
    ordering that Defendant do by 4pm 12/10/07 file in court and serve on the claimant full details of the alleged admin errors referred to in para 3&5 of the application and in default, the application be struck out and the hearing vacated.

    Rang the court today and they haven't done this. What do I do now? Have I won?
    Any advice on what to do next.

    Yes, I actually came to this forum whilst looking for advice on this very matter. I recieved a letter from the HSBC explaining that they had reviewed my overdraft facilty that I've had at the same level for the last 10 years and decided (wait for it) to continue it at the same level (£300). To be honest I do, very occaisionaly go outside the agreed level by £20 or £30 as my wife is disabled and her benefits are paid every four weeks instead of calendar monthly like my salary, so sometimes juggling the cash flow is fun. However I obviously pay charges and interest for these "unauthorised" borrowings.

    Since the letter said that they hadn't done anything, I must admit I didn't read it in detail so I was very surprised to find listed in my online statement an "Overdraft Arrangement Fee" of £25. I telephoned the bank to ask what that related to and was told that I had been sent all of the information in a letter. I pointed out that I've had the same facility for 10 years (since my wife and I got married so I remember how long very clearly) and that nothing had changed. I also pointed out that I had not asked for a review and that I didn't believe that anything in the recent management of my account pointed to any need for one.

    The HSBC customer services rep told me they have instituted annual reviews as part of a policy of being a more responsible lender.

    Basically I'm pretty annoyed about this. I've paid HSBC £25 for them to decide I need the same overdraft facilty as I've had for 10 years and they're telling me that I'll be reviewed again next October (presumably with another £25 charge).

    Any advice ? (Well apart from find another bank ! - I've worked that one out for myself)

    I got this letter too, although I have recently switched accounts to A+L. I've been advised that they will be taking the £25 on or before the 22nd October.
    I shall be calling them tonight to cancel the OD as it is no longer needed, so hopefully I won't get charged.
    Unfortunately for a lot of people they won't be in the position to do this.
    I'm still a bit miffed how they can charge an arrangement fee for an overdraft which has been in place for 3 years?

    Me too! I have just been charged £25 for arranging my overdraft limit of £50 that I have had for 10 years! I was pretty hopping about it and telephoned to query it.

    The advisor said that it was because my limit had changed.

    I said that it remained the same as it has always been.

    She then explained that as I had exceeded my limit in the last six months I had made an 'informal request' to change my limit temporarily, therefore incurring this charge in my annual review. IYSWIM.

    Silly me - seeing as I was charged at the time I think this is a bit outrageous and am seriously considering changing banks too.

    The court really are best placed to tell you if you've won, but it sure sounds like that to me!! If they bank haven't complied with an order of the court then you should be awarded judgement (for a second time!) and if they try to contest that then it should be thrown out - they're simply abusing the system.

    I would write to the court and ask them to confirm that you have received judgement and that it still stands as the bank have not complied with the courts instructions. You should then instruct the bailiffs to collect your money if they don't pay up within the time the judge allows.

    It's bizarre really how they seem to have such a big gap in their service levels! Some people you read about having sent one letter and then getting the claim settled by telephone and money in the bank in days, others (like you and I by the sounds of it!) have to send numerous letters, get refused any information by phone and end up in court with the bank playing nasty.

    I could say 'it's not fair' but I think I would just say I'm puzzled as to what process (if any!) they are following that allows for such a difference in how they treat people.

    Could someone help. I have been out of work for the past month, but recently got a job. However I won't be paid till end of November. I have received a bank charge of £100 for going over my agreed overdraft. This is to be taken out of my account on the 7th Nov. However there will be no money in the account. Will the bank charge me more, if so how much. Or will they wait til I have money in the account before they take more money out? The bank is HSBC.

    hi Chrissie84,
    The bank will certainly take the charge from your account, and also levy more charges onto your account for going over your O/D limit, they won't wait until you get paid. This is how a lot of people ended up fighting to get their money back. You could always try phoning them and explaining your situation, it might help then again it might not, but there's no harm in trying.

  • i have recently started the ball rolling on claiming back around £4000 in bank charges from HSBC. I used Martyn's template letter on the GMTV site. I received a letter from them on 6th August 2007 stating that they have registered and stored my claim and they are waiting for legal proceedings between the OFT and the bank and will contact me as soon as they can. Does this mean that they are fobbing me off with a lot of bank jargon or will they really sort out my claim? Also how long do you think i will have to wait until this is resolved?:confused:
