i went into hsbc today and gave them a letter damanding all my statments 31-08-07, they told me that they suspended all bank charge payments untill it gets sorted out in high court, can anyone tell me if this is true.0

I returned my intial acceptance letter to HSBC, which they say they received on the 10th August. But they are refusing my return because they say they sent another, an updated one (the only difference was the date), and won't do anything at all until I return the letter.
Is this legal? If it's not, what can I say to them to enable the return of my money? They sent out the original acceptance letter before the test case began, and are using this as their reason for refusing to accept it.

They cannnot insist on you signing and returning a new acceptance letter
before they will pay the agreed settlement figure. It is basic contract law that once an offer is accepted there is a binding agreement ask any law student. Telling them that if you do not have a cheque for the settlement figure within 7 days you will sue them for the recovery of the money with interest and costs.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
but it is unfair that some people have had their bank charges back and i havnt, it that not a case in its self?0

The above is absolutely true, however, when I received my second acceptance (the first one was received the day before the announcement to hold all claims was made) the major difference apart from the date was a sentence which basically said that this offer was in full and final settlement - in other words, I can't go back and claim more for the same period once the courts have made a decision.
In all fairness to them (strange I know!!) the offer was for the same amount as the original offer letter and the money was in my account 2 days after they received the signed agreement back - I guess they are just covering their backs.

Following the instructions on this site...I have set up a new account. I then contacted my bank (HSBC) to ask for a list of all charges in the last six years. OMG I was shocked to get within a couple of days a big fat letter from them. Now I had phoned JUST to ask for a list of charges, but the letter they sent me - says "We acknowledge recipt of your complaint about bank charges" etc. They have I guess had a few "complaints". Anyway the letter says that the charges they have listed are only the ones NOT agreed with me in advance...is that right?
I was shocked to see the amount of charges as £3598!
Their letter goes on to say that they cant respond in full to my complaint becuase of the legal proceedings between the OFfice of Fair Trading...they also say that should I proceed with a claim in court they will apply to the court for an order to wait unitl resoloution of the banks proceedings with the office of fair trading.
So do I wait or carry on.....bear in mind I have at no point sent a letter yet...they are just responding to my request for a list of charges.
I am confused!!!!!!0 -

Hi Cathrine,
You are probably going to have to go through the full claim system to get your claim started, due to the statute of limitations, if any part of your charges recalim are nearing 6 years, unless they're recorded in the court system, they will not be included in your final settlement. You wil also need to go to your local court to start your claim, as MCOL are not accepting any more bank charges reclaim. Also, the bank can only ask the court for a stay they cannot tell you what the outcome will be. if you look for threads by TANZARELLI, this poster has a list of courts which are accepting stays, and courts which are going ahead with individual cases.

Hi Everyone,
First of all, congratulations to all of those who have received their cheques already, well done!
I guess Im just after some advice, and I need egging on, Im getting worried now, as my court date is on the 3rd of October, and I have no idea how I am going to defend myself, Im not too sure on what to say, I have a court bundle set out, but have never been to court before, so I have no idea what to expect, Im very nervous, but want to follow it through, is there any advice anyone can give me on what to say or do, or anything I need to make sure Im doing?
Any advice will be greatly appreciated.

I am currently in the process of reclaiming charges from a Sainsburys Credit Card and a Halifax Credit Card - both of which are provided by HBOS.
I sent a DPA letter for each (separately) on 20th August, along with personal cheques for the standard £10 fees. A friend provided the cheques for me as I don't have a cheque book. I clearly stated the credit card number for each account at the top of each letter.
Today, I have received two separate letters. The first relates to my Sainsbury's Card and states "...we are unable to process this request as we do not have sufficient information to confirm all the details required... please provide the account number and sort code..." From the credit card number provided at the top of my letter and the fact that it is addressed to 'Sainsbury's Card Services', surely they know full well that my request relates to a credit card and thus does not require an account number / sort code?!!
The second letter relates to my Halifax Card and states "...we are unable to process this request as we do not have sufficient information to confirm all the details required... please provide your full address details (including previous addresses if you have moved in the last 3 years)..." Ok, I'll give them this one as I did move house about 2.5 years ago, but surely they have details of my previous address linked to my account?!
Are these just blatent stalling tactics in a crafty attempt to keep resetting the 40 day DPA clock? Can anyone confirm whether, in fact, the DPA clock will be considered to be 'reset' each time they request more details?
Also, can anyone think of any other information that they are likely to request so that I can play them at their own game and put a stop to potentially more daft stalling letters?!
One final point... In the letters, they have explained that for bank charges info, HBOS have decided not to charge a fee. However, they have not returned my friend's cheque, but instead, have handwritten "HSBC £10 - No Refund - <Sort Code> <Account Number>" at the bottom of my original letter. Any ideas what they are up to? Have I potentially caused any problems for my friend by supplying his cheques?
Any answers to these would be gratefully received!!0
