Looks like HSBC have decided to apply for judgements to be set aside in a few cases..so looks like their new tactic. They pay £65 to the court to ask for the judgement to be set aside and then you get yet another court date and have to prepare for that.
It must be costing them a fortune to use their legal team and the £65 a throw to get the thing heard, you would think that they'd just pay up where judgement had been granted wouldn't you?
I have a few concerns with them doing this, not least that courts might decide toi stop giving judgements to the claimants because it will make more work for them when the bank comes back with a request to have it set aside.0 -
Paleerie-Head - You would think that the cost would put them off but there is no ryhme or reason to HSBC (& nots let us forget the informous Heidi!!) I would have been more than prepared to accept £7k but NO they werent having any of it, even me threatening FO. so in the end they pay up £9K!!
I'm all for the consumer, so my fingers are crossed for you

OMG!
i COULDN'T BELEIVE IT.... THERE THEY WERE! NOT ONE BUT TWO LETTERS FROM HONESTLY SODDING BANK CHARGES....
DAMN! One of them was for my quarterly review and the other for flaming Bank Account Plus!!!

No joy here my friends.
They have applied for the judgement to be set aside and the judge has to consider that now (and hopefully also consider my reasons given for not setting it aside).
If the judge decides to list it for hearing then I'll have to show up and probably lose anyway.
Feeling pretty negative about it all just now...but of course that's how the robbing expletives want me to feel! Darn that bank!0 -
Thanks to Martin's sample letters,:money: our claim went through quite easily. They agreed to pay all but £20 of what we claimed but am still waiting for it being deposited into the account (2 weeks).
RESULT!:beer:0 -
Out of interest - when did you lodge your claim and did they offer you a settlement or did you win it through the court?0

Hiya guys, can someone answer me a quick question please,, Ive submitted a letter to HSBC asking for charges back, they have replied saying the cant do anything until after it has been looked into, so im not too sure where i go from here.. obviously i dont want to wait and some people have been saying on these threads go ahead with the court stages but i just want to see how everyone else is going about the next stages?

I have tried a letter asking them to apply the same sort of discretion in dealing with may claim that the Master of the Rolls has been urging circuit judges to do i.e judging each case on its merits. I have also urged for an urgent response on the issue as I feel I must continue to apply interest upon my claim for the forseable future for as long as it takes the test case to go through. I intend to register my claim on line asap however I would have hoped an amicable agreement to suit both parties could be reached in the meanwhile...and they know where to find me. I have told them I aim to register this with MCOL 2 weeks today. I have had another letter back with the usual blahdiblah thank you for your letter however as you aware the test case is going through the motions and they have the waiver from the FSA to stay any claims. It is their current policy for them to do this and they will get in touch if the situation changes... Same old anonymous flannel,:mad:
I have signed the petition and written to my MP on writetothem.co.uk (I think!) to ask for his support on the bank charges issue...
I have a strong hope that this waiver gets removed at the end of September so current claims can be processed.

i went into hsbc today and gave them a letter damanding all my statments 31-08-07, they told me that they suspended all bank charg payments untill it gets sorted out in high court, can anyone tell me if this is true.0
